This instrument is the Primary Industries (Excise) Levies Amendment (Citrus and Farmed Prawns) Regulations 2019.

    Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Primary Industries (Excise) Levies Act 1999.

Schedule 1Amendments

Part 1Citrus

Primary Industries (Excise) Levies Regulations 1999

Subclause 7.7(2) of Schedule 15

Repeal the subclause, substitute:

  1. (2)

    For clause 6 of Schedule 27 to the Excise Levies Act, the rates of EPPR levy on citrus are as follows:

    1. (a)

      for oranges in bulk—$1.05 per tonne of oranges;

    2. (b)

      for oranges not in bulk—2.1 cents per box;

    3. (c)

      for other citrus in bulk—$1.05 per tonne of citrus;

    4. (d)

      for other citrus not in bulk—2.1 cents per box.

Part 2Farmed prawns

Before clause 3.1 of Schedule 27

Insert:

Division 3.1Definitions for this Part

Clause 3.1 of Schedule 27

Omit “In these Regulations”, substitute “In this Part”.

After “the rate of levy”, insert “imposed by this Division on farmed prawns”.

Repeal the note, substitute:

Note: For the meaning of producer, see subclause 3.4(1) of Schedule 37 to the Collection Regulations and paragraph (b) of the definition of producerin subsection 4(1) of the Collection Act.

Add:

Division 3.3Special purpose levies

3.5White spot disease repayment levy

Imposition of levy

  1. (1)

    For the purposes of clause 2 of Schedule 27 to the Excise Levies Act, levy is imposed on farmed prawns on which levy is imposed by Division 3.2 of this Schedule.

Rate of levy

  1. (2)

    For the purposes of clause 6 of Schedule 27 to the Excise Levies Act, the rate of levy imposed by this Division on farmed prawns is 3.01 cents per kilogram of farmed prawns, weighed before any part of the prawns is removed.

Who pays the levy

  1. (3)

    For the purposes of clause 11 of Schedule 27 to the Excise Levies Act, levy imposed by this Division on farmed prawns is payable by the producer of the prawns.

    Note: For the meaning of producer, see subclause 3.4(1) of Schedule 37 to the Collection Regulations and paragraph (b) of the definition of producerin subsection 4(1) of the Collection Act.
