AN ACT to amend and continue the operation of the Prices Control Act, 1948-1951 and to repeal the Profiteering Prevention Act, 1939-1941.

BE it enacted, by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:— -

Short title

and citation.

1. (1) This Act may be cited as the Prices Control Act Amendment and Continuance Act, 1952.

In this Act the Prices Control Act, 1948-1951, Act No. 3 of 1948 as continued by Acts Nos. 23 of 1949, 19 of 1950 and 8 of 1951 and amended by Act No. 34 of 1951,

is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Prices Control Act, 1948-1952.

2. The principal Act is amended by adding after section ten a section as follows-

10A. (1) The Commissioner shall exercise the powers conferred on him by section ten of this Act, so far as they relate to fixing and declaring the maximum prices at which butter and cheese may be sold by a person other than a person who is a manufacturer within the meaning of the interpretation "manufacturer" in section seven of the Dairy Products Marketing Regulation Act, 1934-1937, so that those maxi- mum prices shall at all times be based on a

price from time to time determined by the Minister for Commerce and Agriculture of the Commonwealth and notified in writing by him to the Commissioner as the appropriate price for the sale, by a manufacturer, for consump- tion in the Commonwealth of butter or cheese, as the case may be.

(2) In a prosecution for an offence against this Act, objection shall not be taken to an order fixing and declaring the maximum price at which butter or cheese may be sold on the ground that the Commissioner has not complied with the provisions of this section.
