Prevention of Cruelty to Animals (General) Amendment (Offences) Regulation 2010

under the

Prevention of Cruelty to Animals Act 1979

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Prevention of Cruelty to Animals Act 1979.

Explanatory note
The objects of this Regulation are:

(a)	to increase the maximum penalties that may be imposed for offences relating to animal trades and the confinement or use of laying fowl for commercial egg production, and
(b)	to increase the prescribed penalty amounts for those offences if dealt with by penalty notice, and
(c)	to prescribe the offence of failing to comply with a notice issued by an inspector under the Prevention of Cruelty to Animals Act 1979 in respect of a contravention of that Act or the regulations under that Act as a penalty notice offence and to prescribe the penalty amount for that offence if dealt with by penalty notice.

This Regulation is made under the Prevention of Cruelty to Animals Act 1979, including sections 33E and 35 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Prevention of Cruelty to Animals (General)
Amendment (Offences) Regulation 2010.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

[1]      Clauses 17C–17I, 17K–17P and 20 (1)

Omit “25 penalty units” wherever occurring.

Insert instead “200 penalty units in the case of a corporation and 50 penalty units in the case of an individual”.

[2]      Clause 20 Conduct of animal trades

Omit “25 penalty units” from clause 20 (2). Insert instead “50 penalty units”.

[3]      Schedule 3 Penalty notice offences

Insert the following in Columns 1, 2 and 3, respectively, after the matter relating to section 23 (2):
