Prevention of Cruelty to Animals (Amendment) Regulations 2007

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to make further provision in relation to fees and procedures for scientific procedures licences.

2Authorising provision

These Regulations are made under section 42 of the Prevention of Cruelty to Animals Act 1986.

3Commencement

These Regulations come into operation on 1 January 2008.

4Fees for scientific premises licences

For regulation 30 of the Prevention of Cruelty to Animals Regulations 1997[1] substitute

"30   Permit to operate rodeo or rodeo school

(1)For the purposes of section 16(1) of the Act, the prescribed fee for the issue of a rodeo permit is—

(a)for the first day of the rodeo, 5 fee units; and

(b)for each subsequent day, 2×4 fee units.

(2)For the purposes of section 16(1) of the Act, the prescribed fee for the issue of a rodeo school permit is 2×5 fee units.

30AScientific procedures premises licence

(1)For the purposes of section 30(2)(b) of the Act, the prescribed fee for the issue of a scientific procedures premises licence is, for each year or part of a year—

(a)in the case of a licence for the purposes of scientific procedures undertaken by or at a registered school within the meaning of the Education and Training Reform Act 2006, nil;

(b)in the case of a licence for the purposes of scientific procedures undertaken by or at a children's service within the meaning of the Children's Services Act 1996, nil;

(c)in any other case—

(i)if 10 or more persons are conducting scientific procedures, 57×2 fee units;

(ii)if less than 10 persons are conducting scientific procedures, 38×1 fee units.

(2)For the purposes of section 32J(2)(b) of the Act, the prescribed fee for the renewal of a scientific procedures premises licence is, for each year or part of a year—

(a)in the case of a licence for the purposes of scientific procedures undertaken by or at a registered school within the meaning of the Education and Training Reform Act 2006, nil;

(b)in the case of a licence for the purposes of scientific procedures undertaken by or at a children's service within the meaning of the Children's Services Act 1996, nil;

(c)in any other case—

(i)if 10 or more persons are conducting scientific procedures, 57×2 fee units;

(ii)if less than 10 persons are conducting scientific procedures, 38×1 fee units.

30BScientific procedures field work licence

(1)For the purposes of section 32B(2)(b) of the Act, the prescribed fee for the issue of a scientific procedures field work licence is, for each year or part of a year—

(a)in the case of a licence for the purposes of scientific procedures undertaken by or at a registered school within the meaning of the Education and Training Reform Act 2006, nil;

(b)in the case of a licence for the purposes of scientific procedures undertaken by or at a children's service within the meaning of the Children's Services Act 1996, nil;

(c)in any other case—

(i)if 10 or more persons are conducting scientific procedures, 57×2 fee units;

(ii)if less than 10 persons are conducting scientific procedures, 38×1 fee units.

(2)For the purposes of section 32J(2)(b) of the Act, the prescribed fee for the renewal of a scientific procedures field work licence is, for each year or part of a year—

(a)in the case of a licence for the purposes of scientific procedures undertaken by or at a registered school within the meaning of the Education and Training Reform Act 2006, nil;

(b)in the case of a licence for the purposes of scientific procedures undertaken by or at a children's service within the meaning of the Children's Services Act 1996, nil;

(c)in any other case—

(ii)if less than 10 persons are conducting scientific procedures, 38×1 fee units.

30CSpecified animals breeding licence

(1)For the purposes of section 32F(2)(b) of the Act, the prescribed fee for the issue of a specified animals breeding licence, for each year or part of a year is 57×2 fee units.

(2)For the purposes of section 32J(2)(b) of the Act, the prescribed fee for the renewal of a specified animals breeding licence, for each year or part of a year is 57×2 fee units.".

5Amendment to Schedule 6

For clause 1 of Schedule 6 to the Prevention of Cruelty to Animals Regulations 1997 substitute
