Prevention of Cruelty to Animals (Amendment)

Regulations 1996

The Governor in Council makes the following Regulations:

1. Objectives

The objectives of these Regulations are—

(a)

to prescribe identification certificates for specialist inspectors appointed under the Prevention of Cruelty to Animals Act 1986; and

(b)

to exclude from the definition of "scientific procedure" in section 25 of that Act scientific procedures carried out on live fish or live crustaceans.

2. Authorising provisions

These Regulations are made under sections 19, 25 and 42 of the Prevention of Cruelty to Animals Act 1986.

3. Principal Regulations

In these Regulations the 1Prevention of Cruelty to Animals Regulations 1986 are called the Principal Regulations.

4. Substitution of regulation 7

For regulation 7 of the Principal Regulations
substitute—
"7. Identification certificates

(1) An identification certificate issued to an inspector under section 19(1) of the Act must be in the form of Schedule 2.

(2) An identification certificate issued to a specialist inspector under section 19(2) of the Act must be in the form of

Schedule 2A.".

5. New regulation 11B inserted

After the heading to Part 3 of the Principal

Regulations insert—

"11B. Prescribed scientific procedure

For the purposes of paragraph (j) of the definition of "scientific procedure" in section 25 of the Act, a scientific procedure carried out on or in connection with a live fish or live crustacean is prescribed.".

6. New Schedule 2A inserted

After Schedule 2 to the Principal Regulations insert—

"SCHEDULE 2A

Regulation 7

CERTIFICATE OF IDENTIFICATION AS A SPECIALIST

INSPECTOR

The bearer whose signature appears in the margin is a

specialist inspector appointed under section 18A of the Prevention of provided under section 22A of that Act.
