(Penalty Notice Offences) Regulation 2019

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Prevention of Cruelty to Animals Act 1979.

Explanatory note

The object of this Regulation is to prescribe an offence under section 23A of the Prevention of Cruelty to

Animals Act 1979 (as inserted by the Companion Animals and Other Legislation Amendment Act 2018) as
a penalty notice offence. That section requires a person advertising regulated dogs or cats for sale or for
giving away to include certain information in the advertisements.

This Regulation is made under the Prevention of Cruelty to Animals Act 1979, including sections 23A (Information required when dogs or cats are advertised for sale or for giving away), 33E (Penalty notices) and 35 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Prevention of Cruelty to Animals Amendment (Penalty Notice

Offences) Regulation 2019.

2      Commencement

This Regulation commences on 1 July 2019 and is required to be published on the
NSW legislation website.
