PREVENTION OF CRUELTY TO

ANIMALS AMENDMENT ACT

No. 36 of 1987

AN ACT to amend the Prevention of Cruelty to Animals Act 1920.

[Assented to 30 June 1987]

BE it enacted by the Queen's Most Excellent Majesty, by and with the

advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. This Act may be cited as the Prevention of Cruelty to Animals

Amendment Act 1987.

Principal Act

2. In this Act the Prevention of Cruelty to Animals Act 1920* is

referred to as the principal Act.

Section 4 amended

3. Section 4 of the principal Act is amended in subsection (1)-

(a) in paragraph (ma) by deleting "promotes or takes" and substituting the following-

" promote or take ";

(b) in paragraph (mb) by deleting "keeps or has" and substituting the following-

" keep or have "; and

(c)	by deleting "Maximum penalty: Two hundred dollars or six months imprisonment, and an additional penalty of twenty dollars for every day on which an offence under paragraph (c) is
continued." and substituting the following -

"

Penalty: $5 000 or 12 months imprisonment. ".

Section 7 amended

4. Section 7 of the principal Act is amended in subsection (5) by deleting "penalties prescribed in section four hereof." and substituting the following-

" penalty prescribed in section 4. ".

Section 20 amended

5. Section 20 of the principal Act is amended in subsection (3) by

deleting "not exceeding twenty dollars for the first occasion, and not exceeding forty dollars for the second or any subsequent occasion, on which he so fails," and substituting the following-

" of $200 ".

Various penalties amended

6. The principal Act is amended by deleting in the provisions referred to in column 1 of the Table to this section the penalties respectively set out in column 2 of the Table and substituting in each case the corresponding penalty set out in column 3 of the Table.
