An Ordinance to amend the Prevention of Cruelty to Animals Ordinance 1959

Ordinance under the Seat of Government (Administration) Act 1910.

O R D I N A N C E 1980

Short title

(Amendment) Ordinance 1980.1 1. This Ordinance may be cited as the Prevention of Cruelty to Animals

Principal Ordinance

Cruelty to Animals Ordinance 1959. 2 2. In this Ordinance, "Principal Ordinance" means the Prevention of
Minister of State for the time being administering this Ordinance;".

Commencement

3. This Ordinance shall come into operation on such date as is fixed by the

Minister of State for the Capital Territory by notice in the Gazette.
Repeal of sections 2 and 3

4. Sections 2 and 3 of the Principal Ordinance are repealed.

Interpretation

5. Section 4 of the Principal Ordinance is amended by inserting after the

definition of "animal" the following definition:

" 'Department' means the Department of State administered by the

Exceptions

6. Section 7 of the Principal Ordinance is amended by omitting para­

graphs (a) and (b) and substituting the following paragraphs:

"(a) in killing an animal in accordance with the provisions of the Nature

Conservation Ordinance 1980;

(b) in killing an animal specified in the Schedule;

(ba) in killing a rabbit or an animal that is a noxious animal within the

meaning of the Rabbit Destruction Ordinance 1919;

(bb) in hunting, snaring, trapping, shooting or taking a rabbit or an ani­ mal that is a noxious animal within the meaning of the Rabbit Destruction Ordinance 1919; or".

Trapping of animals by mechanical means

7. Section 12 of the Principal Ordinance is amended by omitting from sub­

section (1) "Department of the Interior" and substituting "Department".

Schedule

8. The Principal Ordinance is amended by adding at the end thereof the

following Schedule:
