AN ACT to amend the Prevention of Cruelty to

Animals Act, 1920-1948.

[Assented to 11th November, 1958.]

BE it enacted, by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Prevention and citation.

of Cruelty to Animals Act Amendment Act, 1958.

(2) In this Act the Prevention of Cruelty to Animals Act, 1920-1948, is referred to as the prin- cipal Act.

(3) The principal Act as amended by this Act may be cited as the Prevention of Cruelty to Animals Act, 1920-1958.

ment. 2. This Act shall come into operation on a day

to be fixed by proclamation.

amended. 3. Section three of the principal Act is amended by adding after paragraph (h), the following paragraph-

"Society" means The Royal Society for the

(i)  Prevention of Cruelty to Animals, Western Australia (Incorporated) or The Eastern Goldfields Society for Prevention of Cruelty to Animals (Inc.) or any other society incorporated under the provisions of the Associations Incorporation Act, 1895-1957, and which has for its aims and objects the prevention of cruelty to animals.

amended. 4. Section four of the principal Act is amended

(a)	by substituting for the words, "Twenty- five pounds" in line one of the penalty provisions at the foot of subsection (1), the words, "Fifty pounds"; and
(b)	by deleting the passage commencing with the words, "Minimum penalty" in line four of those penalty provisions and ending with the word, "shillings" being the last word in those penalty provisions.

amended.	5. Section five of the principal Act is amended by deleting the words, "not exceeding ten pounds" in line seven.

amended.	6. Section seven of the principal Act is amended by deleting the words, "for the Prevention of Cruelty to Animals"—

(a)	in lines one and two of subsection (1);
(b)	in line three of subsection (3); and
(c)	in line seven of subsection (4).

7. Section eight of the principal Act is amended amended.

(a)	by deleting the words, "for the Prevention of Cruelty to Animals" in lines one and two; and
(b)	by substituting for the words, "Ten pounds" in the penalty provisions at the foot of the section, the words, "Twenty-five pounds".

9. Section fourteen of the principal Act is amended.

amended by deleting the words, "for the Prevention of Cruelty to Animals" in line three of the passage added to that section by section nine of Act No. 18 of 1948.

10. Section fifteen of the principal Act is amended.

amended by substituting for the words, "any society for the prevention of cruelty to animals" in lines two and three, the words, "the Society".

11. Section seventeen of the principal Act is amended by substituting for the words, "Ten pounds" in the penalty provisions at the foot of the section, the words, "Twenty-five pounds". amended.

Section twenty-two of the principal Act is amended by substituting for the penalty provisions the following- amended. 22

13. Section twenty-four of the principal Act is emended

amended by adding after the word, "trap" in line two and again in line five, the passage, ", snare, or other device,".
