PRESTIGE & RICH PTY LTD

v

JANEY ELLEN MCGREGOR OF THE OFFICE OF FAIR TRADING

[2021] HCASL 33
B67/2020

  1. In December 2018, the applicant was convicted and sentenced in relation to an offence of an agent's failure to pay an amount in dispute under s 28(2)(a) of the Agents Financial Administration Act 2014 (Qld). The applicant's appeal against conviction and sentence to the District Court of Queensland (Rackemann DCJ) pursuant to s 222 of the Justices Act 1886 (Qld) was dismissed with costs. The applicant's application for leave to appeal to the Court of Appeal of the Supreme Court of Queensland (Boddice J, Sofronoff P and Philippides JA agreeing) was dismissed on the ground, among others, that the applicant's appeal did not have any prospects of success.

  2. The applicant identifies no error of principle which it would be in the interests of justice for this Court to consider.  There is no reason to doubt the correctness of the decision of the Court of Appeal.  The application should be dismissed.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
