The court was required to decide whether it should grant a stay of the order pending the hearing of the appeal. The court considered the relevant principles and the balance of convenience between the parties. The court noted that the appeal was listed for hearing in less than four weeks from the filing of the interlocutory application. The court also noted that Mr Brown was a bankrupt and would suffer financial hardship if the order was stayed. The court considered that the interests of justice favoured the preservation of the existing order in Mr Brown's favour, pending the hearing of the appeal.
