CaseChat Overview and Summary

Premier Fire Pty Ltd sought approval of an enterprise agreement under the Fair Work Act 2009. The applicant was a small business employing a small number of employees, with the proposed agreement covering certain employees within the CEPU Electrical Division Queensland. The Fair Work Commission was tasked with determining whether the agreement met the requirements for approval under the Act. The central legal issue was whether the agreement complied with the provisions of the Fair Work Act, particularly in terms of its fairness and the process by which it was negotiated.

The Commission examined the procedural fairness of the agreement, considering whether the parties had genuinely negotiated the terms of the agreement and whether there was any evidence of coercion or undue influence. The Commission also assessed the substantive fairness of the agreement, examining whether the terms provided for a fair and reasonable outcome for the employees. The Commission noted that the agreement provided for fair wages and conditions, and that there was no evidence of any procedural unfairness in the negotiation process. The Commission concluded that the agreement was fair and reasonable, and approved it under the Act.
