CaseChat Overview and Summary
The legal issues before the court encompassed whether the union had properly represented its members in the negotiation of the agreement, whether the process adhered to the requirements set forth in the Fair Work Act 2009, and whether the terms of the agreement were fair and reasonable. Additionally, the court had to consider if the agreement met the 'better off overall test' as stipulated by the legislation, ensuring that employees would not be worse off financially as a result of the new agreement.
The Fair Work Commission found that the union had adequately represented its members, and the negotiation process was conducted in a procedurally fair manner. The court also determined that the agreement met the better off overall test, as it provided various benefits to employees that outweighed any financial disadvantages. Consequently, the Commission approved the Precast Tasmania Agreement 2016, recognising it as a fair and reasonable enterprise agreement for the employees involved.
