PART 1

PRELIMINARY

1. (a) These regulations may be cited as the Poultry Processing Regulations, 1971.

(b)

These regulations are divided into the following parts.—

Part I—Preliminary.

Part II—Testing.

Part III—Labelling.

Part IV—Miscellaneous.

Part V—Appeals.

2. In these regulations, unless the context otherwise requires:—

"Act" means the Poultry Meat Industry Act, 1969;

"Committee" means the "Poultry Meat Industry Committee";

"Minister" means the Minister of Agriculture.

3. An application for the registration of a poultry processing plant shall be in the form of Form A in the schedule to these regulations and shall be forwarded to the Minister together with the sum of $25.00 which is hereby prescribed as the fee pursuant to section 11(2) of the Act.

4. Notice to the Minister by a person who has become the operator of a poultry processing plant shall be in the form of Form B in the schedule to these regulations.

5. A certificate of registration of a poultry processing plant shall be in the form of Form C in the schedule to these regulations.

6. An application for the registration of two or more registered poultry processing plants as one plant shall be in the form of Form D in the schedule to these regulations and shall be forwarded to the Minister together with the sum of $15.00 which is hereby prescribed as the fee pursuant to section 11(3) of the Act.

7. A certificate of registration of two or more poultry processing plants as one plant shall be,

mutatis mutandis, in the form of Form C in the schedule to these regulations.

8. An application by the registered operator of two or more poultry processing plants registered as one plant for the separate registration of any one of those poultry processing plants shall be in the form of Form E in the schedule to these regulations and shall be forwarded to the Minister together with the sum of $15.00 which is hereby prescribed as the fee pursuant to section 11(4) of the Act.

9. A certificate of registration issued by the Minister in consequence of an application pursuant to regulation 8 of these regulations shall be mutatis mutandis, in the form of Form C to these regulations.

9a. An application for approval of a farm or proposed farm, or to operate a farm or proposed farm, shall be in the form of Form G in the schedule to these regulations and shall be forwarded to the Committee, together with the sum of $10.00, which is hereby prescribed as the fee pursuant to section 11i(2) of the Act.

9b. A certificate of approval granted by the Committee in consequence of an application pursuant to regulation 9a of these regulations shall be in the form of Form H in the schedule to these regulations.

PART II TESTING

10. The number of poultry carcasses to be removed by an inspector from a poultry processing plant for the purpose of testing the average weight gain of carcasses shall be twenty- two.

11. Each poultry carcass referred to in regulation 10 shall be separately removed from the processing cycle in a poultry processing plant.

12. The period during which carcasses may be removed for the purposes of a weight gain test shall be not less than 30 minutes from the time of the removal of the first carcass for that test. A test shall subject to that limitation, occupy such time as the inspector carrying out that test determines.

13. Each carcass shall be removed from the processing cycle after evisceration of that carcass has been completed and prior to that carcass making contact with water in the course of the washing, chilling and draining sections of the processing cycle.

14. Each carcass removed from a processing cycle by an inspector for the purposes of a test of average weight gain shall be clearly and legibly identified by a tag of distinctive colour, letter and number. Each carcass shall have feet and legs removed below the hock (tarsal) joint.

15. Each carcass shall, forthwith after removal from the processing cycle, pursuant to regulation 13, be weighed to the nearest gramme. The weight of each carcass shall be recorded against the number and letter of the tag attached to that carcass.

16. After each carcass has been removed from the processing cycle, identified and weighed, that carcass shall be returned to the processing cycle at the position in the poultry processing plant from which it was removed during a processing cycle.

17. The first twenty poultry carcasses which have, during a test, been identified and otherwise dealt with in accordance with these regulations shall, after each of those carcasses has completed the washing, chilling and draining sections of the processing cycle, be individually weighed, to the nearest gramme, and those weights recorded against the number and letter of their identification tags respectively.

18. The weight of the first twenty identified carcasses removed from the poultry processing plant after passing through the processing cycle shall be aggregated, and that aggregate weight is the "end weight". The sum of the weights of those twenty carcasses disclosed on the record made pursuant to regulation 15 is the "base weight".

19. An inspector may test carcasses at any time or at any stage of processing during the operation of a poultry processing plant.

20. After the second weighing of the carcasses the tags shall be removed therefrom and the carcasses may be retained by the inspector in the processing plant in a separate container.

PART III

LABELLING

21. (1) Each poultry carcass shall forthwith after processing be packaged or labelled.

(2) The label on each carcass or packaged carcass shall have legibly displayed thereon the words "with giblets" or "without giblets" as the case may be. The words "with giblets" and "without giblets" shall be legible and in heavy capitals not less than 0.11 of an inch in height.

22. If a carcass is packaged with or accompanied by a giblet pack it shall be labelled accordingly. A giblet pack may contain not more than one of each of the following parts of poultry:—

Heart, liver, gizzard, neck;

provided that if a neck only is with the carcass that carcass or the package containing that carcass

shall be labelled "without giblets".

23. No other parts of poultry or other materials except the neck of a carcass shall be included in or with a carcass or package containing a carcass.

24. All giblet packs shall be made of a non-absorbent plastic material.

25. A carcass shall not contain, include or be packaged with the feet or legs of poultry below the hock (tarsal) joint.

26. A carcass shall not contain or be packaged with more than one poultry neck.

PART IV

MISCELLANEOUS

27. A person shall not in any form or other document used in connection with any matter arising under these regulations make any statement false or misleading in any material particular knowing it to be false or misleading.

28. The penalty for an offence against these regulations shall be a fine not exceeding two

hundred dollars.

PART V APPEALS

29. An appeal under section 16 of the Act shall be made in the form of Form F in the schedule to these regulations and shall contain the information indicated therein and shall be instituted by delivering such form to the Minister within one month of the date of the direction appealed against.

30.

(1)

Notice of appeal under section 15b of the Act shall be given in the form of Form I in the schedule to these regulations and shall indicate the information contained therein.

(2)

Such notice shall be lodged with the Poultry Farmer Licensing Review Tribunal within one month of the date of the decision of the Committee appealed against.
