POULTRY MEAT INDUSTRY ACT 1986—REGULATION

(Relating to notification of ballots and elections of members of the Poultry

Meat Industry Committee who represent growers)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Poultry Meat Industry Act 1986, has been pleased

to make the Regulation set forth hereunder.

The Poultry Meat Industry (Committee Members) Regulation 1988 is

amended:

(a) by omitting from the definitions of “calling of the ballot” and “calling of the election” in clause 3 (1) the word “first” wherever occurring;
(b) by omitting clause 14 and by inserting instead the following clause:

Notification of election

14. (1) The returning officer must, as soon as possible after having been notified in writing by or on behalf of the Minister that one or more members are required to be appointed for the purposes of section 4 (3) (c) of the Act:

(a)

cause to be published in the Gazette a notification stating that an election is to be held for that purpose and fixing the time and date for the close of nominations; and

(b) send by post a notice in writing to each grower:

stating that an election is to be held for that purpose; and

specifying that one or more members are required

to be appointed to represent independent growers

or to represent Association growers (or both); and

• calling for nominations of candidates; and

specifying the time and date fixed under paragraph (a) for the close of nominations; and

advising where nomination forms may be obtained; and

specifying the places where nominations may be lodged; and

specifying the qualifications that qualify a grower to nominate a candidate; and

(c)

notify the secretary of the Committee in writing that an election is to be held for that purpose and of the time and date fixed under paragraph (a) for the close of nominations.

(2) The date fixed under subclause (1) (a) for the close of

nominations must not be earlier than 21 days or later than 28 days

after the date on which the notification is published in the Gazette.

(c)

by omitting clause 23 (1) and by inserting instead the following subclause:

(1) The returning officer must, as soon as practicable after

receiving the preliminary roll or rolls for the election:

(a) cause to be published in the Gazette a notification:

stating that an election is being held for the purpose

of appointing one or more members to represent

independent growers or to represent Association growers (or both) for the purposes of section 4 (3) (c) of the Act; and

• stating that a ballot is to be taken; and

fixing the time and date for the close of exhibition of the rolls; and

fixing the time and date for the close of enrolments; and

fixing the time and date for the close of the ballot; and

(b) send by post a notice in writing to each grower:

stating that an election is being held for the purpose of appointing one or more members to represent independent growers or to represent Association growers (or both) for the purposes of section 4 (3) (c) of the Act; and

stating that a ballot is to be taken; and

specifying the times and dates fixed under paragraph (a) for the close of exhibition of the rolls, the close of enrolments and the close of the ballot; and

specifying the places where copies of the preliminary roll or rolls will be exhibited; and

specifying the qualifications that qualify a grower to vote; and

specifying the places where applications for enrolment and objections against enrolment may be lodged; and

(c)

cause copies of the preliminary roll or rolls to be exhibited for public inspection for a period of not less than 14 days ending at the close of exhibition of the rolls and at a place specified under paragraph

(b) for exhibition of the roll or rolls.

EXPLANATORY NOTE

The object of this Regulation is to amend the Poultry Meat Industry (Committee

Members) Regulation 1988:

to provide for notification of elections and ballots for members of the

Poultry Meat Industry Committee who represent growers to be published in

the Gazette instead of in at least one newspaper circulating throughout New
South Wales
to require details and information about such elections and ballots to be sent by post to each grower.

This Regulation is made under the Poultry Meat Industry Act 1986, including section 4 (3) (c) (constitution of Committee) and section 23 (the general regulation-making power).
