B E it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legis­ lativeAssemblyof Queensland in Parliament assembled, and by the authority of the same, as follows:— 1. (1.) This Act may be cited as “The Poultry Short title. Industry Acts Amendment Act of 1959.” (2.) *“ The Poultry Industry Acts, 1946 to 1950,” Pnnoipai are in this Act referred to as the Principal Act. Aot' (3.) The Principal Act and this Act may be Collective collectively cited as The Poultry Industry Acts , 1946 1 e' to 1959.” 2. Subsection seven of section six of the Principal Af™e Act is amended by repealing the second paragraph0 s‘ thereof and inserting, in lieu of that repealed paragraph, the following paragraph :— “ If a member, other than the Minister, is absent from any meeting of the Advisory Board, the Minister may, by writing under his hand, appoint a person to represent the said member at such meeting.” 3. Section 10 b of the Principal Act is amended Amendments of s. 10 b . by repealing subsections four and five thereof and erting, in lieu of those repealed subsections, the following subsection:— (4.) Subject to appropriation by Parliament, the easurer shall in each and every year pay into the 'und from Consolidated Revenue the sum of ten thousand ounds and in addition the sum equal to the total of he amounts of all precepts issued under this section n the year in question.” 4. Subsection seven of section twelve of the Aofms.en1d2m( 7e) n.t cipal Act is amended by rep_ ealing the first graph thereof and inserting, in lieu of that repealed P graph, the following paragraph :— “ Every registered stock supplier shall pay to the Jnder Secretary such annual registration fee as may be prescri 1 b 0 e G d . .” 6 No. 33 and amending Act.

Section thirteen of the Principal Act is repealed and, in lieu of that repealed section, the following section is inserted :— [13.] (1.) The Under Secretary may, subject to compliance by the owner thereof with the prescribed terms, provisions and conditions, register any holding or premises as any one or more of the following, that is to say, an accredited breeding establishment, an accredited hatchery, and an accredited hatchery-supply farm. (2.) Application for the registration under this section of any holding or premises shall be made to the Under Secretary by the owner thereof, shall be in the prescribed form, and shall be accompanied by the prescribed fee. Upon the registration under this section of any holding or premises the Under Secretary shall issue to the owner thereof the prescribed certificate of registration. Such certificate shall specify the accreditation or accreditations set out in subsection one of this section in respect of which the holding or premises in question is or are registered under this section. (3.) The Under Secretary may refuse to register under this section any holding or premises, or he may so refuse in respect of any particular accreditation set out in subsection one of this section. He may at any time cancel any registration under this section either absolutely or in respect of any particular accreditation set out in subsection one of this section. The Under Secretary may make any refusal or cancellation authorised by this subsection without assigning any reason therefor.” Repeal of 6 . Section fourteen of the Principal Act is repealed and^new an(j 5 in lieu of that repealed section, the following section ' * is inserted :— Offence to C< [14.] ( 1 .) Any owner of a breeding establishment, unregistered batchery, or hatchery-supply farm who, at any time premises. when such breeding establishment, hatchery, or hatchery-supply farm is not registered under this Act

Poultry Industry, Etc., Act. as an accredited breeding establishment, an accredited hatchery, or an accredited hatchery-supply farm, as the case may be, or any stock supplier who at any time when he is not registered as a stock supplier in respect of any premises— (i.) Advertises or notifies or in any other manner represents that such breeding establishment, hatchery, or hatchery-supply farm is an accredited breeding establishment, an accredited hatchery, or an accredited hatchery-supply farm, or, in the case of a stock supplier, that he is registered as such in respect of the premises in question ; or (ii.) Has any words, signs, or letters displayed in any manner whatsoever, or allows to remain unobliterated any words, signs, or letters that have been so displayed over or about any land, premises, or place upon which his breeding establishment, hatchery, or hatchery-supply farm is situated or, as the case may be, upon which he carries on his business of stock supplier, that lead to the belief or supposition that such breeding establishment, hatchery, or hatchery-supply farm is registered as an accredited breeding establishment, an accredited haichery, or an accredited hatchery-supply farm, or, in the case of a stock supplier, that he is registered as such in respect of the premises in question; or (iii.) Places or causes to be placed any placard, board, writing, or thing in the public view to the intent that it may be believed or supposed that such breeding establishment, hatchery, or hatchery-supply farm is registered as an accredited breeding establishment, an accredited hatchery, or an accredited hatchery-supply farm, or, in the case of a stock supplier, that he is registered as such in respect of the premises in question, shall be guilty of an offence. 529

If the owner of any breeding establishment, hatchery, or hatchery-supply farm or any stock supplier, who has been convicted of an offence against this section, allows the words, signs, or letters, or the placard, board, writing, or thing in respect of which he was convicted to remain unobliterated or in the public view, as the case may be, for a period of three days following such conviction, any inspector may obliterate or cause to be obliterated such words, signs, or letters, or may remove or cause to be removed such placard, board, writing, or thing, and for that purpose the inspector concerned or any person authorised in writing by him may with or without assistants enter upon such breeding establishment, hatchery, or hatchery-supply farm, or other place where such words, signs, letters, placard, board, writing, or other thing is or are.” Repeal of and new s. 15. Certificate of freedom from pullorum disease. 7. Section fifteen of the Principal Act is repealed and, in lieu of that repealed section, the following section is inserted:— “[15.] (I.) Where the Under Secretary is satisfied that the young of poultry produced at any accredited breeding establishment, accredited hatchery, or accredited hatchery-supply farm are free from pullorum disease he may issue a certificate to that effect to the owner of such accredited breeding establishment, accredited hatchery, or accredited hatchery-supply farm : Provided that the Under Secretary may refuse to issue such certificate or may at any time cancel any such certificate without assigning any reason for such refusal or cancellation. (2.) Any stock supplier who advertises or notifies or in any way holds out that any breeding establishment, hatchery, or hatchery-supply farm owned by him, other than an accredited breeding establishment, an accredited hatchery, or an accredited hatchery-supply farm in respect of which a certificate as prescribed by subsection one of this section is in force is free from pullorum disease, shall be guilty of an offence and liable to a penalty of not more than fifty pounds. (3.) In any proceedings for an offence against this section the averment in the complaint that the defendant owned premises other than an accredited breeding establishment, an accredited hatchery, or an

Poultry Industry, Etc., Act. accredited hatchery-supply farm in respect of which a certificate as prescribed by subsection one of this section is in force shall, unless such certificate is produced in evidence in respect of such premises, be sufficient evidence of the fact so averred.” 531 8 . Subsection one of section sixteen of the Principal Act is amended by adding to paragraph ( 6 ) ° s' thereof the words “ unless such business, fowls or eggs are certified as prescribed to be accredited, approved, supervised or guaranteed as so described ”. ' 9. The Second Schedule to the Principal Act is of™e°ondntB amended— schedule. (a) By inserting in clause 29 b thereof— (i.) After the words and brackets “ (whether thereat or being conveyed therefrom) ”, the words and brackets “ prescribing, providing for, regulating and controlling the inspection of any place where carcasses are sold and of all carcasses for sale or apparently intended for sale at any place (whether thereat or in the course of being conveyed thereto) ” ; and (ii.) After the words “ the condemnation and disposal of any such poultry or carcasses of poultry affected or infected with disease or the flesh of which is unfit for human consumption,” the words “ the basis of payment for poultry supplied to such slaughter­ houses and which or the carcasses of which are condemned by an inspector as being affected or infected with disease or unfit for human consumption,” ; and (b) By inserting after clause 29 b thereof the following clauses:— 29c. Prescribing, providing for, regulating and controlling the books and records pertaining to their businesses to be kept by licensees, owners and occupiers of slaughter-houses, holdings and other places in or on which poultry are kept or sold for slaughtering for human consumption, and the manner of keeping such books and records, and the entry in or into slaughter-houses, holdings and other places for the purpose of inspecting, and the inspection of such books and records (including the making of copies thereof or extracts therefrom). 29 b . Prescribing, providing for and regulating the returns to be made to the Under Secretary and the contents thereof, by licensees, owners and occupiers of slaughter-houses, holdings or other places in or on which poultry are kept or sold for slaughtering, and the time and mode of making and furnishing the same.”
