  1. The applicant requires an extension of time within which to seek special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of New South Wales (Ward A-CJ and Adamson JA), which relevantly refused the applicant leave for an extension of time to file a summons seeking leave to appeal against a judgment of the Supreme Court of New South Wales (Ball J) summarily dismissing proceedings commenced by the applicant. The applicant also seeks leave to file a further amended application for special leave to appeal.  

  2. The decision below is clearly correct. It would therefore be futile to grant an extension of time and leave to file a further amended application.

  3. Special leave to appeal is refused.
