Statutory Rules 1951, No. 72.(c)

Commencement.

1. These Regulations shall come into operation on the ninth day of July, 1951.

2. Regulation 3 of the Postal Regulations is repealed and the following regulation inserted in its stead:—

Definitions.

“3. In these Regulations, unless the contrary intention appears—

‘the Act’ means the Post and Telegraph Act 1901-1950;

‘the Rates Act’ means the Post and Telegraph Rates Act 1902-1951.”.

Late fees.

3. Regulation 7 of the Postal Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “One penny” and inserting in their stead the word “Twopence”;

(b)by omitting from sub-regulation (2.) the word “Twopence” and inserting in its stead the word “Fourpence”;

(c)by omitting from that sub-regulation the figure “6” and inserting in its stead the figure “5”; and

(d)by omitting from sub-regulation (3.) the word “Twopence” and inserting in its stead the word “Fourpence”.

Rationing papers.

4. Regulation 61b of the Postal Regulations is repealed.

(e) Made under the Post and Telegraph Act 1901-1950 on 5th July, 1951; notified in Gazette on 6th July, 1951.

Post office express messenger service.

5. Regulation 91a of the Postal Regulations is amended by omitting from sub-regulation (2.) the figures and letters “2d.”, “3d.”, “4d.” and “6d.” (wherever occurring) and inserting in their stead the figures and letters “3d.”, “4d.”, “6d.” and “9d.”, respectively.

Fee in respect of article having dutiable contents.

6. Regulation 96 of the Postal Regulations is amended by omitting the word “Threepence” and inserting in its stead the word “Sixpence”.

Fees.

7. Regulation 129 of the Postal Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1.) the figures “4 0 0”, “5 0 0” and “6 0 0” and inserting in their stead the figures “6 0 0”, “7 10 0” and “9 0 0”, respectively;

(b) by omitting from paragraph (b) of that sub-regulation the figures “6 0 0”, “7 10 0” and “9 0 0” and inserting in their stead the figures “9 0 0”, “11 5 0” and “13 10 0”, respectively; and

(c) by omitting from sub-regulation (2.) the figures “1 10 0”, “0 10 0” and “2 0 0” and inserting in their stead the figures “2 5 0”, “0 15 0” and “3 0 0”, respectively.

Mail matter exceeding capacity of box rented.

8. Regulation 134 of the Postal Regulations is amended by omitting from paragraph (b)the sign and figure “£1” and inserting in their stead the words “Two pounds”.

Fees for private bag services.

9. Regulation 143 of the Postal Regulations is amended—

(a) by omitting from paragraph (a)of sub-regulation (1.) the figures and letters “1”, “2” and “6s. 8d.” and inserting in their stead the figures and letters “1 10 0”, “3 0 0” and “10s. 0d.” respectively; and

(b) by omitting from paragraph (b)of that sub-regulation the figures “1” and “2” and inserting in their stead the figures “1 10 0” and “3 0 0”, respectively.

Fee for locked bag service.

10. Regulation 145 of the Postal Regulations is amended by omitting from sub-regulation (1.) the sign and figure “£2” and inserting in their stead the words “Three pounds”.

Lockers for holding locked bags.

11. Regulation 146 of the Postal Regulations is amended by omitting from sub-regulation (1.) the sign and figure “£2” and inserting in their stead the words “Three pounds”.

Preparation of articles for registered post.

12. Regulation 162 of the Postal Regulations is amended by omitting from sub-regulation (4.) the word “Sixpence” and inserting in its stead the word “Ninepence”.

Fees and compensation in respect of articles other than C.O.D. parcels.

13.—(1.) Regulation 163 of the Postal Regulations is amended by omitting the table and inserting in its stead the following table:—

(2.) Regulation 163 of the Postal Regulations is amended by omitting from the proviso the word “Sixpence” and inserting in its stead the word “Ninepence”.

Fees and compensation in respect of C.O.D. parcels.

14. Regulation 164 of the Postal Regulations is amended by omitting from sub-regulation (1.) the word “Sixpence” and inserting in its stead the word “Ninepence”.

Fee for registration of article sent to place beyond the Commonwealth.

15. Regulation 171 of the Postal Regulations is amended by omitting the word “Sixpence” and inserting in its stead the word “Ninepence”.

Acknowledgment of receipt.

16. Regulation 174 of the Postal Regulations is amended by omitting the word “Threepence” (wherever occurring) and inserting in its stead the word “Sixpence”.

Commission.

17. Regulation 180 of the Postal Regulations is amended—

(a)by omitting the word “Sixpence” and inserting in its stead the word “Ninepence”; and

(b)by omitting from the table the figures “1 0”, “1 3”, “1 6”, “1 9” and “0 3” and inserting in their stead the figures “1 6”, “1 9”, “2 0”, “2 3” and “0 4”, respectively.

Posting of parcels.

18. Regulation 192 of the Postal Regulations is amended by omitting from sub-regulation (3.) the word “Sixpence” and inserting in its stead the words “One shilling”.

Acknowledgment of delivery.

19. Regulation 196 of the Postal Regulations is amended by omitting the word “Threepence” and inserting in its stead the word “Sixpence”.

Bullion, jewellery and other valuables.

20. Regulation 197 of the Postal Regulations is amended by omitting the words “One shilling” (wherever occurring) and inserting in their stead the words “One shilling and sixpence”.

Customs clearance charge.

21. Regulation 203 of the Postal Regulations is amended by omitting the word “Sixpence” and inserting in its stead the words “One shilling”.

Demurrage.

22. Regulation 205 of the Postal Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations:—

“(1.) Where a postal article from a place beyond the Commonwealth having contents—

(a)on which Customs duty is payable; or

(b)imported through the post for commercial purposes (whether liable to Customs duty or not),

remains undelivered at the Chief Parcels Office or a post office at which duty is assessed by an officer of Customs for more than seventy-two hours

 

(exclusive of Sundays and holidays) after the posting to the addressee of a notification of its arrival, demurrage on the parcel shall, subject to this regulation, be chargeable at a rate—

(c)where the parcel remains undelivered for less than three hundred and sixty hours after the expiration of the period of seventy-two hours after the posting of the notification—of Fourpence for each twenty-four hours or part thereof; and

(d) where the parcel remains undelivered for more than three hundred and sixty hours after the expiration of the period of seventy-two hours after the posting of the notification—of Fourpence for each twenty-four hours or part thereof in the first three hundred and sixty hours and Sixpence for each twenty-four hours or portion thereof after the first three hundred and sixty hours.

“(1a.) Demurrage is not chargeable for any period in respect of which it is shewn that the detention of the article was not due to the fault or negligence of the sender or the addressee or a person acting on behalf of the sender or the addressee.

“(1b.) The last preceding sub-regulation does not relieve the addressee from liability to pay demurrage where the detention of the article is due to delay in producing invoices, documents, descriptions of contents or information required by an officer of Customs.”.

23.—(1.) Regulation 213 of the Postal Regulations is amended by omitting the table from sub-regulation (1.) and inserting in its stead the following table:—

(2.) Regulation 213 of the Postal Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “Federal Capital Territory” (wherever occurring);

(b)by omitting from that sub-regulation the words “North and Central Australia” (wherever occurring) and inserting in their stead the words “Northern Territory”;

(c)by omitting from that sub-regulation the words—

“From Federal Capital Territory to—

Queensland.

Victoria.

Tasmania.”;

(d)by omitting from that sub-regulation the words—

“From Federal Capital Territory to—

South Australia.

Western Australia.

North and Central Australia.”; and

(e)by omitting sub-regulation (2.) and inserting in its stead the following sub-regulation:—

24. Regulation 226 of the Postal Regulations is repealed and the following regulation inserted in its stead:—

“(2.) The remitter of a money order payable in or through a country specified in the last preceding sub-regulation other than the Commonwealth, Nauru, New Caledonia, Norfolk Island, Papua, New Guinea, Gilbert and Ellice Islands, Solomon Islands or Tonga shall pay,

in addition to the commission specified in that sub-regulation, a sum determined by the Department as the sum necessary to cover exchange on the amount remitted.”.

26. Regulation 258 of the Postal Regulations is amended by omitting the table and inserting in its stead the following table:—
