| Postmaster’s oath. | 2. And be it enacted That the Postmaster General and every other Postmaster appointed under this Act shall before the exercise hy him of the duties of his office take and subscribe an oath for the due execution of such duties before one of His Majesty’s Justices of the Peace which oath such Justice is hereby authorized and required to administer in thc words following that is to say |

of the Established Church of England the Colonial Secretary the Colo nial Treasurer the Puisne Judges of the Supreme Court thc Attorney General the Auditor General tJie Shoritf the Surveyor General the Inspector of Colonial Hospitals the Clerk of the Councils the Assistant Colonial Secretary thc Collector of Internal Ilevenuc the Brigade Major thc Military Secretary the Officer in charge of the Commissariat Department the Officer in charge of the Commissariat Account Department the Principal Superintendent of Convicts and tlie Postmaster General or such other persons as they may respectively depute to act in their laAvful and necessary absence and any such other officers as thc Governor shall from time to time direct to send and receive letters and packets by the post free from tlie charge of postage Provided that all letters so to be sent by the public officers above mentioned be hond fide on the public service and bo franked in their OAvn liandAvriting.

11. And he it enacted That all printed newspapers and letters Newspapers and

12. And he it enacted That no letter from any non-commissioned Soldiers and sailors
officer private soldier seaman or marine actually employed and on full iM̂J'one'̂ penny
pay in thc army navy or marines shall ho chargeable with a higher
rate of postage than one penny to he paid at the time of putting such Icttei- into the Post Office Provided that every such letter he written on a single sheet of ])aper only and that there he Avritten on the same in the handwriting of and signed hy the commanding officer for the time-being the Avords “ Soldier's Seaumids or Marine's Lcller" as the case may be Avith thc name of thc corjis regiment detachment or shi]) to Avhich such non-commissioned officer soldier seaman or marine belongs nor shall any letter Avritten on a single sheet of paper directed to any such non-commissioned officer soldier seaman or marine if concerning his private affairs only and specifying upon the same his corps regiment detachment or ship he chargeahle Avith more than one penny or Avith any postage Avhatever if deliverable in Sydney and if any postage Avhatever shall appear to have been already paid thereon in the United Kingdom.
13. And he it enacted That every letter received at any Post Foreign letters to
Office in the Colony from parts beyond the sea addressed to any convict Avithin the same not holding a ticket of leave shall Ite tr;insmittcd from such office to the Principal Superintendent of Convicts in Sydney to he by him subscribed with his signature and
forAvarded through the post free of any charge to the convict to Avhom
addressttd to any such convict as aforesaid upon his or her OAvn private
such letter shall be addressed and e ery letter Avritten on a single Letters Ly convicts
shetd of paper and transmittcxl open under cover to the Principal
Supt'rintcndent of Convicts at Sydney hy any such convict as aforesaid
on his or her private affairs only and addressed to any person in parts
beyond the sea shall upon receipt thereof he subscribed hy the
Principal Superintendent of Convicts in like manner and fonvarded
through the post free of any Colonial charge and every letter written inland letters to
on a single sheet and transmitted open under cover as aforesaid to the
affairs only shall and may upon receipt thereof he marked “ Convict’s
Letter” hy such Superintendent or Police Magistrate respectAely and
superscribed as hereinhefore directed and fonvarded through the post
free of charge.
14. And he it enacted That the Postmaster General shall neiivery of letters.
Avithout any extra charge in that respect cause at such convenient
times as shall he appointed all letters and packets directed to persons at any place or places Avithin such parts of the toAvn of Sydney as shall he from time to time hy any public notice appointed to he left at their respective offices of business or usual places of abode being within the said limits upon payment of the postage due thereon hut unless with respect to letters and packets directed to places within such jiarts of the toAvn of Sydney as aforesaid neither the Postmaster General nor any other Postmaster shall he compelled to deliver letters

or packets excepting only at liis Post Office \vithin sucli reasonable
hours as shall he appointed for that purpose.
| Unclaimed letters. | 15. | And be it enacted That as soon as possible after the expira |
tion of twenty-four hours next following the reccijit of any mail the Postmaster by whom or into whose Post Office thc same shall have been received shall cause a list of all the then remaining unclaimed and undelivered letters and packets received in or by such mail to be made out in writing and alExcd in or on some conspicuous part of his Post Office and that such list or some other list or lists containing a true account or statement of all letters and packets from time to time remaining unclaimed or for delivery shall be kejjt so affixed fairly Avritten and legible as aforesaid for the space of not less than thirty days next folloAAung the first receipt of such letters and packets respectiA^ely at the expiration of Avhich said period of thirty days or as soon as possible aftenvards ca ery such unclaimed or undeliA'cred letter and packet shall hy such Postmaster be transmitted to the

| Return of letters. | 10. Provided ahvays and lie it enacted That except in thc case of such unclaimed and undelivered letters as aforesaid no letter or packet AvliatcA'cr shall under any circumstances be returned to the Avriter or sender thereof Avithout tlie express consent of the person to Avhom the same is directed nor unless by virtue of an express warrant in Avriting under the hand of the Governor shall any letter or packet he sent or delivered otherwise than according to the direction of the same. |
| Mail contractors. | 17. And be it further enacted That it shall be laAvful for the Postmaster General for the time-being under such instructions as shall be from time to time in that behalf given to him by the GoA'ernor to enter into any contract or contracts in Avriting from time to time in his own name on behalf of the Government or in respect of the carriage or conveyance of the several mails throughout this Colony or any or either of them and to sue and be sued upon such contracts accordingly and if any person having entered into any such contract shall during the continuance thereof unlaAvfully refuse or neglect to perform thc same or shall in any manner omit to comply Avith any stipulation or provision therein he or she shall forfeit and pay a penalty or sum of not less than five pounds nor more than fifty pounds over and above the penalty recoverable upon such default by Aurtue of any bond into wliich such person or his or her sureties may ha\"e entered for the due performance of the contract. |
| Letters on board | 18. And Avhereas after thc arrival of vessels in thc port or harbours of this Colony from parts beyond the sea letters and ncAvspapers directed to persons within this Colony have been in some instances a long time detained on board thereof Be it there fore enacted That all mails bags boxes or packets of letters or ncAVspapers and also all loose letters and newspapers Avhich at the time of the arrival of any vessel Avithin the limits of any such port or harbour shall be on board of such vessel directed to any person or persons Avithin this Colony or its Dependencies shall be delivered on demand to any Postmaster or Port Officer of such port or harbour or to any person duly acting for such Postmaster or Port Officer excepting ahvays letters concerning goods on lioard such A'essel and to be delAered Avith such goods and letters containing any conveyance or other deed commission Avrit or aflidavit and letters sent hy AAuy of introduction only or concerning the hearer’s private affairs and any master passenger or other person on board of such A'essel who shall knowingly detain on lAoard of such A'essel or keep in his or her possession any mail mail bag mail box packet of letters letter or |

of twenty-four hours next after the arrival of such vessel to
receive from the nearest Postmaster (who is hereby required to
pay such master or person) the sum of one penny for every letter
or packet so delivered on demand as aforesaid or delivered volun
tarily to any Postmaster or Port Officer or at any Post Office
excepting only mail hags and packages received according to law
from the General Post Office in England and letters or packets
addressed to the Governor and every such master or person shall
give a receipt for the money so received which receipt shall he
to the Postmaster obtaining such letters or packets a sufficient voucher
and the same shall he allowed him in his account accordingly^
20. And he it enacted That if any such Port Officer or person rcnaity for deiayins
in that behalf deputed by him or by any such Postmaster as aforesaid shall neglect or omit to deliver or shall retard the delivery of any hag box mail letter packet or newspaper at the place or Post Office for that purpose appointed by any regulation to be made as hereinbefore mentioned such person shall forfeit and pay a penalty or sum of not less than five pounds nor more than twenty pounds.
21. And whereas masters or other persons having the command Vessek depaHing
of vessels departing from this Colony have in some cases refused to peUed* toVakem̂â i™! command of any vessel about to depart from this Colony shall (after being thereto required by any such Postmaster or Port Officca-) refuse or wilfully neglect to receive on hoard such vessel any mail or hag or box of letters directed to any part or place heyond the sea for which such vessel shall then be hound or shall refuse or neglect carefully to deposit such mail or hag or box in some secure or dry place on hoard of such vessel or to convey the same upon her then intended voyage such master or person shall for every such offence forfeit and pay a penalty or sum of not less than fifty

board have refused to convey therein letters directed to persons at
places heyond the sea whereby great damage and inconvenience
have in some cases been sustained hy merchants and other persons

shall for every such letter or packet forfeit and pay a penalty or sum of not less than two pounds nor more than twenty pounds and that every such letter and packet sent or carried or taken charge of to he carried otherwise than hy post shall he deemed in any prosecution for this offence to have been for hire or reward unless the contrary shall he shewn by the defendant.
| Exceptions. | 23. Provided always and be it enacted That nothing herein contained shall extend to any letter exceeding four ounces in weight nor to any letter or packet concerning goods sent with such goods and to be delivered therewith or containing any writ or proceeding out of any Court of Justice or deed conveyance attidavit or letter of attorney nor to any letter or packet sent by any person concerning his or her private affairs hy any special messenger nor to any letter or packet hond fide sent or carried to or from a Post Office or to or from any place distant live miles or upwards from any Post Office or place appointed for the receipt or delivery of post letters. |

And be it enacted That if the drAer of any mail coach or other carriage used for the couA cyance of the mail or the guard or any person in charge of a mail Avhether coii eyed by any such carriage or on horseback or foot shall loiter on the road or Avilfully misspend or lose time so as to retard the arrAal of the mail at its proper destina tion or shall not in all possible cases convey such mails at a speed of such a number of miles an hour as are fixed by the Postmaster General for the conveyance thereof unless the circumstances of the weather or thc badness of the roads or the occurrence of any accident shall preA^ent the same then and in eAxry such case the driver or guard or person in charge (as the case may be) so offending and being conA'icted thereof hy his OA\m confession the vicAV of a Justice or the oath or oaths of one or more credible Avitness or Avitnesses shall forfeit and pay a sum of not less than one pound nor more than five pounds for every such offence. |

this Colony then this present Act and every provision herein shall
from thenceforth absolutely cease and determine.
