W HEREAS for the peace, welfare, good government Preamble. and economic welfare of the State of Queensland it is considered desirable that early action be taken in and towards marshalling and conserving the finances of the State on a planned system and to build up a reserve fund to aid post-war reconstruction and the future development of the said State: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the ~ egislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as "The Post-war Short title• . The following moneys may be paid to the TinrtuostthFeund. ncraemditeloyf: t-he Trust Fund for the purposes of this Act, (a) Such amounts from the Consolidated Revenue Fund as shall be from time to time approved by the Governor in Council by Order in Council and appropriated by Parliament; (b) The interest received from or the proceeds of any investment of the Trust Fund as herein- after provided. Disburse- ments from the Trust Fund. (3.) Out of the Trust Fund shall be paid- (a) The expenses of the administration of this Act; (b) Such disbursements for the objects and purposes of this Act as may be approved by the Governor in Council by Order in Council and appropriated by Parliament. In any Order in Council it may be indicated that of the amount set out therein as being paid from Consolidated Revenue into the Trust Fund, such amount or defined portion thereof shall represent a particular department or service; and moreover, such Order in Council may contain a direction that such amount or defined portion thereof shall be applied in its disburse- ment only in and for the purposes specified in such Order in Council and in respect of the particular department or service concerned; and in that event such direction shall enure and have effect and shall be obeyed. Investment 4. In any case, in any financial year, when the total ~~ ~ ~ rJ! ~ n balance to the credit of the Trust and/or Special Funds balances of constituted or to be constituted at the Treasury, would, ~ rulil~ t nd/ or in the opinion of the Treasurer, warrant his investing F~ ~ J: . a portion of such balance, he may recommend to the Governor in Council accordingly: and on approval by the Governor in Council signified by Order in Council, such investment shall be made by the Treasurer accordingly. Any such investment may be made in accordance with section six of this Act, and the provisions of such section shall, mutatis mutandis, apply and extend

(a) In any securities of, or guaranteed by, the Government of the Commonwealth or of the State; or (b) On deposit in the Commonwealth Bank; or (c) In such other securities as may be approved by the Treasurer. 7. (1.) The Treasurer of Queensland, representing the Treasur~ r a sCor I oewunn, dsehratlhl,efnoramtheeapnudrpsotysleesooff" thTihseATcrte, abseuraercoorfpQoureaetinosn- c W or & pIoratIOn land," and by that name shall have perpetual succession and an official seal, and shall be capable in law of suing and being sued, and subject to this Act shall have power to take, purchase, sell, exchange, lease, assign, transfer, surrender to the Crown, mortgage and hold lands, goods, chattels, and other property, and subject to this Act may do and execute such other acts, matters, and things as may be necessary or convenient to the proper exercising and performance of his powers, functions, authorities, and duties under this Act. (2.) All Courts, judges, justices, and persons acting judicially shall take judicial notice of the seal of the Treasurer of Queensland affixed to any document or notice and until the contrary is proved shall presume that any such signature or such seal as the case may be, was duly affixed to any document or notice concerned. (3.) Any securities or deposits taken or made in pursuance of this Act may be taken or made by the Treasurer in his corporate name. (4.) Any interest received from, or the proceeds of any investment of moneys as provided by this Act shall be paid into the Trust Fund. 8. The provisions of this Act shall have effect and operation in respect of the financial year beginning with the first day of July, one thousand nine hundred and forty-two, and in respect of every financial year there- after, and to that extent shall have retrospective operation.
