1      Name of Plan

This Plan is Port Stephens Local Environmental Plan 2013 (Amendment No 24).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the following land at Medowie:

(a)

Lot 1, DP 567481, being 730 Medowie Rd,

(b)

Lot 2, DP 567481, being 722 Medowie Rd,

(c)

Lot 7, DP 855814, being 714 Medowie Rd,

(d)

Lot 8, DP 855814, being 702 Medowie Rd,

(e)

Lot 9, DP 855814, being 688 Medowie Rd,

(f)

Lot 199, DP 17437, being 733 Medowie Rd,

(g)

Lot 200, DP 19739, being 717 Medowie Rd.

4      Maps

The maps adopted by Port Stephens Local Environmental Plan 2013 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

(1)

This clause applies to the following land at Medowie:

(d)

Lot 8, DP 855814, being 702 Medowie Rd,

Lot 199, DP 17437, being 733 Medowie Rd,

(g)

Lot 200, DP 19739, being 717 Medowie Rd.

Despite any other provision of this Plan, development consent must not be granted to development on land to which this clause applies unless the consent authority is satisfied that arrangements, acceptable to the consent authority, have been made for the decommissioning of the poultry farm on Lot 199, DP 17437, being 733 Medowie Rd, Medowie.
