An Act to amend the Port Rates Act, 1975, as a consequence of amendments made to the Maritime Services Act, 1935, by the Maritime Services (Amendment) Act, 1978. [Assented to, 16th March, 1978.]

Port Rates {Amendment).

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows ;—

1.     This Act may be cited as the “Port Rates (Amendment) Short title.

Act, 1978”.

2.      (1) Except as provided in subsections (2) and (3), this Commence-

Act shall commence on the date of assent to this Act.

(2) Section 3 (b) shall commence on the date appointed and notified under section 13 j a of the Maritime Services Act, 1935.

(3) Section 4 shall commence on the day appointed and notified under section 2 (2) of the Maritime Services (Amend­ ment) Act, 1978.

The Port Rates Act, 1975, is amended—

(a)

(i)

by omitting from the definition of “scheduled port” Sec. 5. in section 5 ( 1 ) the words “specified in the (interpre­

Schedule” and by inserting instead the words “, or

'

a part of a port, specified in the Schedule but does

not include a vested port” ;

(ii)

by omitting from section 5 (1) the definition of “vested port” and by inserting instead the following definition ;—

“vested port” means a port, or that part of a port,

for the time being vested in the Board;

(b) by Omitting from the Schedule the words “Port Kembla”.

The Port Rates Act, 1975, is further amended—
