Port of Newcastle Operations Pty Ltd v Australian Competition and Consumer Commission

Port of Newcastle Operations Pty Ltd (PNO) sought judicial review of a decision by the Australian Competition and Consumer Commission (ACCC) to arbitrate an access dispute concerning the Port of Newcastle. The dispute was initiated by Glencore, a coal producer, which sought arbitration on the reasonable level of navigation service charges and access terms imposed by PNO on coal vessel users. PNO argued that the arbitration should not proceed as the statutory preconditions for initiating the dispute had not been met. The court was required to determine whether the ACCC's decision to arbitrate was valid and whether the issues raised by PNO were ripe for judicial determination.

The court held that the arbitration process had been validly commenced and should be permitted to proceed. The court found that Glencore was a "true" access seeker and that its requests were amenable to the arbitration process. The court also found that the prejudice to PNO from engaging in the arbitral process and the prospect of a final determination was insufficient to justify an exercise of discretion in its favour. The court dismissed PNO's application for judicial review, with costs.

The court granted an extension of time for PNO to apply for judicial review and ordered that the proposed originating application be taken to be filed on a specified date. The court also dismissed the originating application and ordered PNO to pay the respondents' costs of the application for the extension of time and the originating application as agreed or taxed.
