McHUGH J:   Mr Keane, I have been informed that the Port of Brisbane Corporation matter has been settled, is that so?

MR KEANE:   Yes, it is, your Honour; it settled last night.

KIRBY J:   That is a great misfortune, Mr Keane.

McHUGH J:   What do you want us to do about it?

MR KEANE:   The only orders we would seek would be that your Honours by consent dismiss the application with no order as to costs.

McHUGH J:   Do you agree with that, Mr North?

MR NORTH:   By consent, your Honours.

McHUGH J:   In the matter of Port of Brisbane Corporation v ANZ Securities Limited, by consent the application will be dismissed with no order as to costs.
