1      Name of Plan

This Plan is Port Macquarie-Hastings Local Environmental Plan 2011 (Amendment

No 52).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the land to which Port Macquarie-Hastings Local

Environmental Plan 2011 applies.

4      Maps

The maps adopted by Port Macquarie-Hastings Local Environmental Plan 2011 are amended or replaced, as the case requires, by the maps approved by the local plan-making authority on the making of this Plan.

[1]      Land Use Table

Insert “Industrial retail outlets;” in alphabetical order in item 3 of Zone RU1 Primary

Production, Zone RU2 Rural Landscape and Zone RU5 Village.

[2]      Land Use Table, Zone B2

Insert “Industrial retail outlets;” in alphabetical order in item 4.

[3]      Land Use Table, Zones B7, IN3 and IN4

Omit “Industrial retail outlets;” from item 4 wherever occurring.

[4]      Clause 4.1 Minimum subdivision lot size

Insert after clause 4.1 (3):

(3A) If a lot is a battle-axe lot or other lot with an access handle, the area of the access handle is not to be included when calculating the size of the lot for the purposes of this clause.

[5]      Schedule 5 Environmental heritage

Omit “Memorial Gates” from item no I100 in Part 1.

Insert instead “Bain Park, including Memorial Gates”.
