I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Port Macquarie-Hastings Local Environmental Plan 2011 (Amendment

No 38).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the land to which Port Macquarie-Hastings Local

Environmental Plan 2011 applies.

4      Maps

The maps adopted by Port Macquarie-Hastings Local Environmental Plan 2011 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

5 Amendment of Port Macquarie-Hastings Local Environmental Plan 2011

(1)

Land Use Table

Omit “Veterinary hospitals;” from item 4 of the matter relating to Zone B5 Business

Development.

(2)

Clause 7.14 Eco-tourist facilities—additional provisions

Omit clause 7.14 (2) (a). Insert instead:

(a)

development for the purposes of a dwelling house or dual occupancy (attached) is not prohibited on the subject land under clause 4.2A, and

(3)

Schedule 1 Additional permitted uses

Insert after clause 5:

6      Use of certain land at 764 Fernbank Creek Road, Fernbank Creek

(1)

This clause applies to land at 764 Fernbank Creek Road, Fernbank Creek, being that part of Lot 10, DP 1185123 that is in Zone SP3 Tourist, shown as “Item 6” on the Additional Permitted Uses Map.

(2)

Development for the purposes of agricultural produce industry, cellar door premises and light industry (being a brewery) is permitted with development consent.
