I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

Environmental Planning and Assessment Act 1979

1      Name of Plan

This Plan is Port Macquarie-Hastings Local Environmental Plan 2011 (Amendment

No 34).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the land to which Port Macquarie-Hastings Local

Environmental Plan 2011 applies.

4      Maps

The maps adopted by Port Macquarie-Hastings Local Environmental Plan 2011 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

Schedule 1

Amendment of Port Macquarie-Hastings Local

Environmental Plan 2011

[1]      Clause 1.2 Aims of Plan

Insert at the end of clause 1.2 (2):

(m)

to provide effective and efficient connectivity and movement corridors within and between subdivisions.

[2]      Land Use Table

Insert “Extractive industries;” in alphabetical order in item 3 of the matter relating to

Zone RU2 Rural Landscape.

[3]      Land Use Table, Zone RU3

Insert “Agriculture; Extractive industries;” before “Roads” in item 3.

[4]      Land Use Table, Zones RU5, R1, R2, R3, R4, R5, B1, B2, B3 and B4

Omit “Home-based child care;” from item 2 wherever occurring.

[5]      Land Use Table, Zones RU5 and R2

Insert “Home-based child care;” in alphabetical order in item 3.

[6]      Clause 5.3 Development near zone boundaries

Omit clause 5.3 (2) (a). Insert instead:

(a)

100 metres from a zone boundary of land that is only within Zone RU1 Primary Production, Zone RU2 Rural Landscape or Zone RU3 Forestry, or

[7]      Schedule 1 Additional permitted uses

Insert at the end of the Schedule:

5      Use of certain land at 27 John Fraser Place, Port Macquarie

This clause applies to land at 27 John Fraser Place, Port Macquarie, being Lot 1, DP 504833, shown as “Item 5” on the Additional Permitted Uses Map.

(2)

Development for the purposes of an animal pound and a depot is permitted

with development consent.

(3)

In this clause, animal pound means a building or place owned or controlled by a public authority or non-profit community organisation that is used for the keeping or caring of animals (other than for the agistment of horses), and includes any associated ancillary veterinary hospital.

[8]      Schedule 5 Environmental heritage

Omit the matter relating to Item nos I045, I048 and I091.
