I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Port Macquarie-Hastings Local Environmental Plan 2011 (Amendment

No 30).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to Lot 17, DP 1191370, 10 Glen Ewan Road, Sancrox.

4      Maps

The maps adopted by Port Macquarie-Hastings Local Environmental Plan 2011 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

Amendment of Port Macquarie-Hastings Local

Environmental Plan 2011

[1]      Land Use Table

Insert at the end of item 1 of the matter relating to Zone IN4 Working Waterfront:

To ensure that industrial activities located in the zone require direct waterfront access or are associated with other industrial activities that require direct waterfront access.

[2]      Land Use Table, Zone IN4 Working Waterfront, item 3

Insert “Industrial training facilities;” and “Wharf or boating facilities;” in alphabetical order.

[3]      Land Use Table, Zone IN4 Working Waterfront, item 4

Omit “Industrial training facilities;” and “Wharf or boating facilities;”.

[4]      Clause 7.16

Insert after clause 7.15:

Development in Zone IN4 Working Waterfront

(1)

The objective of this clause is to ensure that industrial activities proposed to be located in Zone IN4 Working Waterfront require direct waterfront access or are associated with other industrial activities that require direct waterfront access.

(2)

Development consent must not be granted for the purpose of industry on land in Zone IN4 Working Waterfront unless the consent authority is satisfied that the relevant industrial activity requires direct waterfront access or is associated with another industrial activity that requires direct waterfront access.
