Port Authorities Amendment Regulations
(No. 4) 2014
Made by the Administrator in Executive Council.
1. Citation
These regulations are the Port Authorities Amendment
Regulations (No. 4) 2014.2. Commencement
These regulations come into operation as follows —
(a)
regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day after that day.
3. Regulations amended
These regulations amend the Port Authorities Regulations 2001.4. Regulation 3 amended
In regulation 3 delete the definition of Navigation Act and insert:
Navigation Act means the Navigation Act 2012
Navigation Act section 343(2); and
(Commonwealth);
5. Regulation 23 amended
Delete regulation 23(1)(a) and insert:
(a) produces evidence that satisfies the harbour
master that the person meets the medical fitness
requirements in Marine Order 9 (Health —
medical fitness) 2010, given effect under the

Delete regulation 49(2) and insert:
(2) A person complies with this subregulation if the person
holds -
(a) a certificate of competency under the Navigation Act or the Marine Act that authorises the person to command a vessel of each kind for which the pilotage exemption certificate is sought; or (b) a certificate of competency or other qualification recognised by the port authority as equivalent to a certificate of competency described in paragraph (a).
7. Regulation 50 amended
Delete regulation 50(b)(ii) and insert:
(ii) the medical fitness requirements in Marine Order 9 (Health - medical fitness) 2010, given effect under the Navigation Act section 343(2);
8. Schedule 1 clause 74 amended
In Schedule I clause 74(2):
(a) delete paragraphs (a), (b) and (c) and insert: (a) a certificate of competency under the Navigation
Act or the Marine Act that authorises the person to
command a vessel of each kind for which the pilotage exemption certificate is sought; or
(b) in paragraph (d) delete "paragraph (a), (b) or (c)." and insert: paragraph (a).
9. Schedule 1 clause 75 amended
Delete Schedule 1 clause 75(1)(b)(iii) and insert:
(iii) the applicant meets the medical fitness
requirements in Marine Order 9 (Health -
medical fitness) 2010, given effect under
the Navigation Act section 343(2); and

10. Schedule 1 clause 80 amended
In Schedule 1 clause 80(2)(b) delete "health and eyesight," and insert:
medical fitness,
