Made by the Governor in Executive Council.
1. Citation
These regulations may be cited as the Port Authorities
Amendment Regulations 2003.
2. The regulations amended
The amendments in these regulations are to the Port Authorities
Regulations 2001*.[* Published in Gazette 18 May 2001 p. 2417-545. For amendments to 3 December 2002 see Gazette
22 March 2002.]
3. Schedule 1 amended
After Schedule 1 clause 64 the following Division is inserted –“ Division 4A — Esperance Port Authority
64A. Application This Division applies to the Esperance Port Authority and the Port of Esperance.

64B. Unauthorised berthing of fishing vessels prohibited Unless authorised by the harbour master or an authorised
member of staff of the port authority, the master of a fishing
vessel must not berth the vessel at the main wharf of the port
at berth 1, 2 or 3.
Penalty: $2 000.64C. Unauthorised mooring etc. of vessels prohibited Unless authorised in writing by the harbour master, a person
must not moor, anchor, land or beach a vessel in the port.
Penalty: $2 000.64D. Unauthorised placing of fishing gear in port waters
prohibitedUnless authorised in writing by the harbour master, a person
must not place a fishing net, pot or other fishing gear in the
waters of the port.
Penalty: $2 000.”.
4. Schedule 2 amended
(1) Schedule 2 Division 1 is amended as follows:
(a) in item 1 by deleting “$3 294.50” and inserting “ $3 060.00 ”;
(b) in item 2 by deleting “$3 624.50” and inserting “ $3 430.00 ”;
(c) in item 3 by deleting “$3 844.50” and inserting “ $3 700.00 ”;
(d) in item 4 by deleting “$4 064.50” and inserting “ $4 080.00 ”;

in item 8 by deleting “$486.20” and inserting instead — “ $500.00 ”.
(2) Schedule 2 Division 6 is amended as follows:
(a) in item 1 — (i) by deleting “$0.2035” and inserting instead — “ $0.2277 ”; and
(ii) by deleting “$2 200.00” and inserting instead — “ $2 464.00 ”;
(b) in item 2 by deleting “$4 070.00” and inserting “ $4 558.00 ”;
(c) in item 3 by deleting “$4 840.00” and inserting “ $5 421.00 ”;
(d) in item 4 by deleting “$5 390.00” and inserting “ $6 037.00 ”;
(e) in item 5 by deleting “$5 720.00” and inserting “ $6 406.00 ”;
