Ara Act to provide for the Xxtensdon of the City and Port Railway,

from the Port AdeZaide Raittcay Xtation to the 8emaphore

Beach, LeFevre's Peninsda.

HEREAS i t is desirable to extend the City and Port Railway, Preamble.

from the Port Adelaide Railway Station to the Gemaphore Beach, LeFevre's Peninsula, as shown in the plan hereinafter men- tioned, and to provide for the construction of such extension of railway; and for the acquiring of certain lands, also shown in the said plan: And whereas a plan showing the lands proposed to be acquired, which plan is headcd '' Plan showing amended route for Railway from Port Adelaide to the Semaphore," and signed " H.

C. Mais, Egrh-Chief, 22/9/74," together with the book of

reference thereto, have been duly prepared and deposited in the office of the Surveyor-General, at Adelaide-Be it therefore Enacted by the Governor of the Province of South Australia, with the advice and consent of the Legislative Council and House of Assembly of the said Province, in this present Parliament assembled, as follows:

Act," No. 1 of 1850; "'An Act to authorize the appointment of Undertakers fur tlle Construction of the Adelaide City and Port Railway," No 1 of 1851; "The Railway Commissioner's Act," No. 1 1 of 1859; and "The Adelaide and Port Eailway Extended Accommodation Act, 1873," shall be incorporated herewith, and this Act and the said Acts shall bc read and construed together accordingly.

3. Thc: Commissioner of Railways may enter upon and use the roads and streets, aud may enter upon, use, take, and acquire the lands delineated and referred to in the plan showing the line of the said railway and the lands proposed to be so taken, signed " 13. C. Mais, l3gr.-in-Chief, 22/9/74," and ,deposited in the office of the Surveyor-General, at Adelaide, as aforesaid: or so much thereof as shall be or be deemed necessary, and may make and maintain upon the lands so taken or acquired thc railway and bridge shown upon the plan, and also such buildings, erections, vorks, and con- veniencies connected therewith as shall bc or be deemed necessary for such purposes, or any of them.

The said Commissioner shall have and exercise the like powers and authorities with reference to the undertaking hereby autho- rized, as are conferred upon him by the said Act No. 11 of 1859,

purposes of this Act and for carrying out the undertaking hereby authorized, the C'ommissioner shall be deemed to be "The Pro- moters of the Undertaking" mentioned in the said Act No. 6 of 1847, and shall and may have and exercise in relation to the under- taking hereby authorized fill the powers and authorities by such Act vested in "The Promoters of the Underttllring:" And for the purposes of this Act, and for carrying out the undertaking hereby authorized, the said Commissioner shall be deemed to be '''The Company" mentioned in the said Act No. 7 of 1847, and shall and may have and exercise in relation to such undertaking all the

powers and authorities by such Act vested in the Company.

Gauge.

5. The gauge of the said railway hall be five feet three inches,

and the rails to be used in the construction thereof shall be of iron,

and of the weight of not less than forty pounds to the yard.

6. The said Commissioner, in the construction of the rdwity by this Act authorized to be madc, may make the same from the Port Adelaide Railway Station to the Semaphore, according to the route delineated in the said plan, and may carry the same on the level along or across (as the casc may require) the several roads lettered on the plans hereinbefore mentioned as follows, that is to

8. The lands hereby authorized to be taken and acquired, and Exemp5on from 1 0 ~ 1

are hereby declared to be, exempt from sewers, highway, municipal,

police, improvement, and all other local rates and taxes.
