Pollution of Waters by Oil and Noxious Substances

(Amendment) Regulations 1996

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the procedures for notifications under the Pollution of Waters by Oil and Noxious Substances Act

1986 as a result of recent changes to the

administration of ports in Victoria.

2. Authorising provisions

These Regulations are made under section 30 of
the Pollution of Waters by Oil and Noxious

Substances Act 1986.

3. Commencement

These Regulations come into operation on 1
March 1996.

r. 4 S.R. No. 18/1996

4. Principal Regulations

In these Regulations, the 1Pollution of Waters by called the Principal Regulations.

5. New regulation 6 substituted

For regulation 6 of the Principal Regulations
substitute—

"6. Prescribed officers—sections 8 and 10 of

the Act

For the purposes of sections 8 and 10 of the
Act, each of the following officers of the

Marine Board of Victoria is prescribed—

(a)

the Director, Pollution and Navigation Safety;

(b) the Director, Marine Services."

6. Prescribed manner of notifying a discharge

In regulation 7 of the Principal Regulations, for
paragraph (b) substitute—
"(b) The message is conveyed through—

(i)  any office of the Marine Board of Victoria; or

(ii) the Maritime Rescue Co-ordination
Centre, Canberra; and".

7. New regulation 12 substituted

For regulation 12 of the Principal Regulations
substitute—
"12. Prescribed officers—section 13 of the Act

For the purposes of section 13 of the Act the following persons are prescribed officers—

(a)

a person who is authorised in writing by the Environment Protection

Pollution of Waters by Oil and Noxious Substances
(Amendment) Regulations 1996

Authority to be a prescribed officer for the purposes of section 13 of the Act;

(b)

a person appointed under the an authorised officer for the purposes of that Act.".
