POLLUTION CONTROL ACT 1970—REGULATION
(Relating to fee units and certain licence fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Pollution Control Act 1970, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 July 1992.
Amendments
2. The State Pollution Control Commission Regulation 1985 is
amended:
(a)
by omitting clause 1 and by inserting instead the following clause: Citation
1. This Regulation may be cited as the Pollution Control
Regulation 1985.
(b)
by omitting from clause 3 (2) (b) the matter “$68.65” and by inserting instead the matter “$70.50”;
(c) by inserting after clause 5 (2) (f) the following paragraph:
(g)
for premises comprising biomedical waste treatment works—where the amount of biomedical waste treated or destroyed is in quantities, per annum, of:
(i) up to and including 100 tonnes—10 fee units;
(ii) more than 100 tonnes but not more than 500 tonnes—20 fee units;

(iii) more than 500 tonnes but not more than 2 kilotonnes—40 fee units;
(iv) more than 2 kilotonnes but not more than 10 kilotonnes—100 fee units; or
(v) more then 10 kilotonnes—200 fee units.
(d) by omitting clause 6 (2) (e) and by inserting instead the following paragraphs: except as provided by paragraphs (e1) and (f), in the case of any other drain, where the maximum quantity of pollutants permitted to be discharged from the drain under the licence on any day is:
(i) not more than 50 kilolitres—2 fee units;
(ii) more than 50 kilolitres but not more than 200 kilolitres—4 fee units;
(iii) more than 200 kilolitres but not more than 500
kilolitres—10 fee units; (iv) more than 500 kilolitres but not more than 2,000 kilolitres—20 fee units; or
(v) more than 2,000 kilolitres but not more than 18,000 kilolitres—40 fee units;
(vi) more than 10,000 kilolitres—100 fee units;
except as provided by paragraph (f), in the case of any other drain where the pollutants are mainly untreated sewage or sewage that has not undergone secondary treatment, the number of fee units calculated by
multiplying 0.0735 by the maximum quantity of pollutants
(expressed in kilolitres) permitted to be discharged from
the drain under the licence on any day;
EXPLANATORY NOTE
The Pollution Control Regulation 1985 prescribes fees for the issue, renewal and
transfer of licences granted for the purposes of the Clean Air Act 1961, the Clean
Waters Act 1970 and the Noise Control Act 1975. Those fees are expressed as a
number of fee units.
The objects of this Regulation are:
* to increase the value of a fee unit from $68.65 to $70.50 with effect from 1
July 1992; and

* to prescribe the base fee for the issue or renewal of a licence under the
Clean Air Act 1961 in respect of biomedical waste treatment works (the fee payable varies according to the amount of waste treated or disposed of at the works each year); and
* to clarify the meaning of a provision dealing with fees for licences in respect of the discharge of pollutants into water under the Pollution Control Act 1970 and to vary the amount of those fees.
The Regulation also amends the citation of the principal Regulation to reflect the change in the short title of the enabling Act (from the State Pollution Control
Commission Act 1970 to the Pollution Control Act 1970).
