Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Broadcasting Act 1942.

1.   Amendment

1.1   The Political Broadcasts (Tasmania) Regulations are amended as set out in these Regulations.

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 2 (Commencement)

2.1   Omit the regulation.

3.   Regulation 3 (Interpretation)

3.1   Omit the definition of “campaign period”, substitute:

‘campaign period’, in relation to the next election, means the period:

(a)

beginning:

 (i) at the beginning of the day after the day on which nominations for the election close; or

 (ii) at the beginning of the third last Saturday before the election day;

 whichever occurs later; and

  • (b)

    ending at the end of the last Wednesday before the election day;”.

3.2   Insert the following definitions:

‘available broadcasting day’, in relation to the next election, means any day in the campaign period except a Sunday;

‘election day’, in relation to an election, means the day on which the election is to be held;”.

4.   Regulation 4 (What is the prescribed period in relation to the next election?)

4.1   Omit “subsection 95dd (1)”, substitute “subsection 95h (1)”.

5.   Regulation 5 (What is the minimum number of candidates that must contest the next election for a represented party?)

5.1   Omit “paragraph 95dd (1) (b)”, substitute “paragraph 95h (1) (b)”.

6.   Regulation 6 (How is free time granted to a represented party?)

6.1   Omit “subsection 95dd (2)”, substitute “subsection 95h (2)”.

7.   Regulation 7 (What is the total free time available in respect of the next election?)

7.1   Omit the regulation, substitute:

What is the total free time available in respect of the next election?

 “7. For the purposes of the definition of ‘total time’ in subsection 95H (4) of the Act, the total free time available in respect of the next election is the number of minutes calculated using the following formula:

M = EB x ABD x 4

where:

M  is the number of minutes of total free time;

EB  is the number of eligible broadcasters;

ABD  is the number of available broadcasting days.”.

8.   Regulation 8 (How to make an application for a grant of free time)

8.1   Omit “subsection 95df (2)”, substitute “subsection 95k (2)”.

9.   Regulation 9 (How is free time granted to a party to which regulation 6 does not apply or to an independent candidate?)

9.1   Subregulation 9 (1):

Omit “section 95dh”, substitute “section 95m”.

10.   Regulation 10 (Notification of a grant of free time)

10.1   Omit “subsection 95dj (1)”, substitute “subsection 95n (1)”.

11.   Regulation 11 (How will the Tribunal create and allocate units of free time?)

11.1   Subregulation 11 (1):

Omit “subsection 95dk (1)”, substitute “subsection 95p (1)”.

11.2   Subregulation 11 (2):

Omit “subsection 95DK (2)”, substitute “subsection 95P (2)”.

11.3   Subregulation 11 (3):

Omit “subsection 95DK (3)”, substitute “subsection 95P (3)”.

12.   Regulation 12 (How must a broadcaster use a unit of free time?)

12.1   Subregulation 12 (1):

Omit “subsection 95dl (2)”, substitute “subsection 95q (2)”.

12.2   Subparagraph 12 (1) (b) (i):

Omit “6pm and ending at 10pm”, substitute “6 p.m. and ending at 10 p.m.”.

12.3   Subparagraph 12 (1) (b) (ii):

Omit “6pm and ending at 8.32pm”, substitute “6 p.m. and ending at 8.32 p.m.”.

12.4   Paragraph 12 (1) (c):

Omit “8am and ending at 11am”, substitute “8 a.m. and ending at 11 a.m.”.

12.5   Subregulation 12 (3):

Omit the subregulation.

13.   Regulation 13 (When is a broadcaster not required to make a unit of free time available?)

13.1   Subregulations 13 (1) and (2):

Omit “paragraph 95dl (6) (b)”, substitute “paragraph 95q (6) (b)”.

14.   Regulation 14 (How much additional broadcasting time is a licensee entitled to?)

14.1   Omit “subsection 95dl (7)”, substitute “subsection 95q (7)”.
