Political Broadcasts (Australian Capital Territory) Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Broadcasting Act 1942.

1.   Amendment

1.1   The Political Broadcasts (Australian Capital Territory) Regulations are amended as set out in these Regulations.

[NOTE:

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 2 (Commencement)

2.1   Omit the regulation.

3.   Regulation 4 (What is the prescribed period in relation to the election?)

3.1   Omit “subsection 95dd (1)”, substitute “subsection 95h (1)”.

4.   Regulation 5 (What is the minimum number of candidates that must contest the election for a represented party?)

4.1   Omit “paragraph 95 dd (1) (b)”, substitute “paragraph 95h (1) (b)”.

5.   Regulation 6 (How is free time granted to a represented party?)

5.1   Omit “subsection 95dd (2)”, substitute “subsection 95h (2)”.

6.   Regulation 7 (What is the total free time available in respect of the election?)

6.1   Omit “subsection 95de (4)”, substitute “subsection 95h (4)”.

6.2   After “the total”, insert “free”.

7.   Regulation 8 (How to make an application for a grant of free time)

7.1   Omit “subsection 95df (2)”, substitute “subsection 95k (2)”.

8.   Regulation 9 (How is free time granted to a party to which regulation 6 does not apply or to an independent candidate?)

8.1   Subregulation 9 (1):

Omit “section 95dh”, substitute “section 95m”.

9.   Regulation 10 (Notification of a grant of free time)

9.1   Omit “subsection 95dj (1)”, substitute “subsection 95n (1)”.

10.   Regulation 11 (How will the Tribunal create and allocate units of free time?)

10.1   Subregulation 11 (1):

Omit “subsection 95dk (1)”, substitute “subsection 95p (1)”.

10.2   Subregulation 11 (2):

Omit “subsection 95dk (2)”, substitute “subsection 95p (2)”.

10.3   Subregulation 11 (3):

Omit “subsection 95dk (3)”, substitute “subsection 95p (3)”.

11.   Regulation 12 (How must a broadcaster use a unit of free time?)

11.1   Subregulation 12 (1):

Omit “subsection 95dl (2)”, substitute “subsection 95q (2)”.

11.2   Subparagraph 12 (1) (b) (i):

Omit “6pm and ending at 8.32pm”, substitute “6 p.m. and ending at 8.32 p.m.”.

11.3   Paragraph 12 (1) (c):

Omit “8am and ending at 10am”, substitute “8 a.m. and ending at 10 a.m.”.

11.4   Paragraph 12 (3) (c):

Omit “paragraph 95dl (4) (b)”, substitute “paragraph 95q (4) (b)”.

12.   Regulation 13 (How many televised election broadcasts are required?)

12.1   Omit “paragraph 95dl (4) (b)”, substitute “paragraph 95q (4) (b)”.

13.   Regulation 14 (When is a broadcaster not required to make a unit of free time available?)

13.1   Subregulation 14 (1):

Omit “paragraph 95dl (6) (b)”, substitute “paragraph 95q (6) (b)”.

13.2   Subregulation 14 (2):

Omit “paragraph 95dl (6) (b)”, substitute “paragraph 95q (6) (b)”.

14.   Regulation 15 (How much additional broadcasting time is a licensee entitled to?)

14.1   Omit “subsection 95dl (7)”, substitute “subsection 95q (7)”.
