POLICE SERVICE ACT 1990 - REGULATION
(Savings provision relating to discipline)

HIS Excellency the Governor, with the advice of the Executive
Council, and in pursuance of the Police Service Act 1990, has been pleased to make the Regulation set forth hereunder.

The Police Service Regulation 1990 is amended by inserting after clause 3 the following clause:
Disciplinary proceedings - savings provision
3 A The provisions of:
(a) the Police Service Act 1990 and this Regulation; and
| (b) | the Police Regulation (Allegations of Misconduct) Act 1978 and the regulations under that Act, |
relating to disciplinary proceedings against members of the Police Service apply to conduct before as well as to conduct after the commencement of the Police Service Act 1990.
EXPLANATORY NOTE
The object of this Regulation is to make further transitional arrangements in connection with disciplinary proceedings against members of the Police Service in respect of conduct as a member of the Police Force or as a public servant before the commencement of the Police Service Act 1990 on 1 July 1990.

Clause 11 of Schedule 4 to the Police Service Act 1990 provides that any such disciplinary proceedings that are pending under the repealed enactments are to be taken to be pending under that Act. This Regulation makes it clear that the new Act and Regulation (and other relevant statutory provisions) apply to proceedings instituted on or after 1 July 1990 in respect of conduct before that date.
