POLICE SERVICE ACT 1990 - REGULATION

(Entitlement to certificate of discharge)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Police Service Act 1990, has been pleased to make the Regulation set forth hereunder.

The Police Service Regulation 1990 is amended by inserting after

clause 16 (2) the following subclause:

(3) A police officer who is not issued with a certificate of discharge because of any such investigation concerning the conduct of the officer is nevertheless entitled to a certificate if, after the investigation and any proceedings arising from the inverstigation are completed, there is no evidence of misconduct on the part of the officer.

EXPLANATTORY NOTE

At present clause 16 of the Police Service Regulation 1990 provides that a police

officer's entitlement to a certificate of discharge on resignation or retirement does not apply if the police offiver is permitted to resign or retire from the Police Service while the subject of an investigation concerning the conduct of the officer by another police officer or under the Ombudsman Act 1974. The object of this Regulation is to restore the entitlement to a certificate if (after completin of the investigation and any proceedings arising from the investigation) there is no evidence of misconduct on the part of the police officer.
