POLICE SERVICE ACT 1990—REGULATION

(Relating to appointments on probation and annual leave)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Police Service Act 1990, has been pleased to make the Regulation set forth hereunder.

The Police Service Regulation 1990 is amended:

(a) by inserting after clause 61 the following clause:

Appointments on probation

61A. (1) A person when first appointed as an administrative officer is to be appointed on probation for a period of 6 months or for such longer period as the Commissioner directs in respect of the person.
(2) The Commissioner may appoint a person as an administrative officer without the person being required to serve such a period of probation.

(3) If a person is appointed on probation, the Commissioner may (after due inquiry and report):

(a) after the period of probation - confirm the appointment; or

(b)

during or after the period of probation - annul the appointment.

(b)

by omitting the heading to Division 3 of Part 6 and by inserting instead the following heading:

Division 3—Annual leave for police officers
(other than executive officers)

(c) by inserting before clause 75 the following clause:

Definition of “police officers”

74A. In this Division, “police officer” does not include a

member of the Police Service Senior Executive Service.

(d)

by omitting the heading to Division 4 of Part 6 and by inserting instead the following heading:

Division 4—Annual leave for executive

officers, administrative officers

and temporary employees

(e)

by inserting in clause 81 at the end of the definition of “officer” the words “, and includes a police officer who is a member of the Police Service Senior Executive Service”.

EXPLANATORY NOTE

The object of this Regulation is to amend the Police Service Regulation 1990:

(a) to provide for the appointment of administrative officers to the Police

Service on a probationary basis; and

(b) to provide that police officers in the Police Service Senior Executive Service are entitled to the same annual leave entitlements as administrative officers instead of the entitlement of other police officers.
