Explanatory note

Section 70 of the Independent Commission Against Corruption Act 1988 (the 1988 Act) deals with the provision of information in confidence to the Parliamentary Joint Committee known as the Committee on the Independent Commission Against Corruption. In particular, it prohibits the disclosure of such information. Section 24 (7) of the Police Service Act 1990 (the 1990 Act), as in force immediately before the commencement of Schedule l [9] to the Police Legislation Further Amendment Act 1996 (the 1996 Act), applied section 70 of the 1988 Act to the exercise of the Joint Committee’s functions relating to the appointment of the Commissioner of Police.

The object of this Regulation is to provide that section 70 of the 1988 Act

(as applied by former section 24 (7) of the 1990 Act) continues to have

effect to the same extent as it did before the commencement of Schedule 1 [9] to the 1996 Act. The effect of continuing section 70 of the 1988 Act (as

so applied) will be to prohibit the disclosure of information concerning the functions of the Joint Committee that relate to the appointment of the Commissioner of Police.

This Regulation is made under the Police Service Act 1990, including section 219 (the general regulation making power) and clause 2 of Schedule 4.

Insert after clause 4:

4A Continued application of section 70 of the Independent

Commission Against Corruption Act 1988 to Joint

Committee’s functions

(1) The object of this clause is to prohibit the disclosure of certain information concerning the exercise of those functions of the Parliamentary Joint Committee known as the Committee on the Independent Commission Against Corruption that relate to the appointment of the Commissioner of Police.
Corruption Act 1988 (as applied by section 24 (7) of the Section 70 of the Independent Commission Against
Principal Act, as in force immediately before the commencement of Schedule 1 [9] to the 1996 amending Act) continues to have effect with respect to the exercise of the Joint Committee’s functions relating to the appointment of the Commissioner of Police as if the 1996 amending Act had not been enacted.
(3) In this clause, Joint Committee means the Parliamentary Joint Committee known as the Committee on the Independent Commission Against Corruption.
