Explanatory note

Section 67A of the Police Service Act 1990 provides for the creation of eligibility lists of applicants for certain vacant police officer positions and administrative officer positions. That section provides for the use of such an eligibility list not only in respect of the position for which it was created but also for any other position that the Commissioner of Police determines is substantially the same as the position for which the list was created.

The object of this Regulation is to provide that when an eligibility list is created for a police officer position in a Local Area Command another position cannot be determined to be substantially the same as that position unless it is also in that Local Area Command.

This Regulation is made under the Police Service Act 1990, including sections 67A and 219 (the general regulation-making power).

Regulation 2000.

2 Commencement

This Regulation commences on 1 January 2001.

3 Amendment of Police Service Regulation 2000

The Police Service Regulation 2000 is amended as set out in

Schedule 1.

Insert after clause 6:

6A Eligibility lists

When an eligibility list is created under section 67A of the Act for a position in a Local Area Command of non-executive commissioned police officer or police officer of the rank of sergeant, another position cannot be determined to be substantially the same as that position for the purposes of that section unless that other position is a position in that Local Area Command also.
