Made by the Governor in Executive Council.
These regulations are the
These regulations come into operation as follows —
(a) Part 1 — on the day on which these regulations are published on the WA legislation website;
(b) the rest of the regulations — on the day on which the
Firearms Act 2024 section 440 comes into operation.
This Part amends the
(1) In regulation 3(1) delete the definition of
training course in firearms discharge .(2) In regulation 3(1) in the definition of
Superintendent delete “division;” and insert:
division.
(3) Delete regulation 3(3).
(1) At the beginning of regulation 10 insert:
(1) In this regulation —
(a) under the regulations referred to in that section, is the course that an applicant for approval as an authorised person for a Security Agent Business Licence under the
Firearms Act 2024 is required to complete; and(b) if applicable — is taught by a person by whom the approval of the course requires it to be taught.
(2) In regulation 10:
(a) delete “An application” and insert:

(b) delete paragraphs (aa) and (ab) and insert:
(aa) evidence that within the previous 6 months the applicant has successfully completed the relevant training course; and
6. Regulation 14A deleted
Delete regulation 14A.
Delete regulation 38(2) and insert:
(2) A security agent’s general records must include any records received from an approved training provider under regulation 16A in relation to an approved training course conducted by the provider that includes the use of a baton if the records relate to a security officer whose licence is endorsed under section 26 and who has performed licensed activities for the business within the last 3 years.
In Schedule 1 clause 4(1):
(a) delete paragraph (b) and insert:
(b) a Security Agent Business Licence under the
Firearms Act 2024 is in force in respect of the agent’s business; and(ba) the security officer is an authorised person under the
Firearms Act 2024 for the licence referred to in paragraph (b); and(b) in paragraph (c) delete the passage that begins with “applies;” and ends with “and” and insert:
applies.
(c) delete paragraph (d).
Delete Schedule 1 clause 5.
Delete Schedule 1 clause 10.
Delete Schedule 1 clause 11(1).
In Schedule 1 clause 12A(2)(a) delete “

This Part amends the
In Schedule 1:
(a) after item 1 insert:
1A. | Airsoft gun | An article that — (a) has the appearance of being a firearm; and (b) is made or modified to be used to discharge a spherical projectile made of ceramic, metal, plastic or biodegradable material (commonly known as a BB pellet) using a pneumatic, gas, electric or spring-loaded mechanism or a combination of those mechanisms. |
(b) after item 10 insert:
10A. | Flamethrower | An article made or modified to be used to spray ignited incendiary fuel over a distance. |
(c) after item 15 insert:
16. | Spud gun | An article (commonly constructed of PVC or other type of piping) made or modified to be used to discharge organic material (for example, potato) using a pneumatic, gas or spring-loaded mechanism. |
