Police Regulations Amendment (Criminal Law Mental Impairment) Regulations 2024

Made by the Governor in Executive Council.

Part 1Preliminary1.Citation

These regulations are the Police Regulations Amendment (Criminal Law Mental Impairment) Regulations 2024.

2.Commencement

These regulations come into operation as follows —

  • (a)

    Part 1 — on the day on which these regulations are published on the WA legislation website;

  • (b)

    the rest of the regulations — on 1 September 2024.

Part 2Community Protection (Offender Reporting) Regulations 2004 amended3.Regulations amended

This Part amends the Community Protection (Offender Reporting) Regulations 2004.

4.Regulation 6A replaced

Delete regulation 6A and insert:

6A. Sentences (s. 3)

Each of the following is a sentence for the purposes of the definition of that term in section 3 of the Act —

  • (a)

    a pre‑sentence order under the Sentencing Act 1995 Part 3A in force on or after 1 June 2007;

  • (b)

    a community supervision order or an interim or extended community supervision order under the Criminal Law (Mental Impairment) Act 2023, or an interim disposition under section 205(1)(b) of that Act.

     
5.Regulation 7 amended
  • (1)

    In regulation 7(2):

    • (a)

      delete “subject to a custody order made under the Criminal Law (Mentally Impaired Accused) Act 1996 Part 4” and insert:

       

    a detainee under the CLMI Act

     
    • (b)

      in paragraph (ba) delete “Declared Places (Mentally Impaired Accused) Act 2015” and insert:

       

    Declared Places (Mental Impairment) Act 2015

     
    • (c)

      in paragraph (b) delete “release order,” and insert:

       

    leave of absence order,

     
  • (2)

    In regulation 7(3) delete the definition of release order.

  • (3)

    In regulation 7(3) insert in alphabetical order:

     

leave of absence order has the meaning given in the Criminal Law (Mental Impairment) Act 2023 section 77(1);

  • (4)

    In regulation 7(3) in the definition of prison delete “section 3;” and insert:

     

section 3.

  • (5)

    In regulation 7(5) in the definition of resident delete “Declared Places (Mentally Impaired Accused) Act 2015” and insert:

     

Declared Places (Mental Impairment) Act 2015

6.Regulation 18 amended

In regulation 18:

  • (a)

    in paragraph (h) delete “detention.” and insert:

     

detention;

 
  • (b)

    after paragraph (h) insert:

     
  • (i)

    a community supervision order or an interim or extended community supervision order under the Criminal Law (Mental Impairment) Act 2023, or an interim disposition under section 205(1)(b) of that Act.

     
7.Regulation 19 amended

In regulation 19(e)(i) delete “Declared Places (Mentally Impaired Accused) Act 2015” and insert:

Declared Places (Mental Impairment) Act 2015

Part 3Security and Related Activities (Control) Regulations 1997 amended8.Regulations amended

This Part amends the Security and Related Activities (Control) Regulations 1997.

9.Regulation 13A amended

In regulation 13A(2)(aba) delete “Declared Places (Mentally Impaired Accused) Act 2015” and insert:

Declared Places (Mental Impairment) Act 2015

Part 4Surveillance Devices Regulations 1999 amended10.Regulations amended

This Part amends the Surveillance Devices Regulations 1999.

11.Regulation 6 amended

After regulation 6(1)(e)(i) insert:

  • (iia)

    Criminal Law (Mental Impairment) Act 2023 section 55(3)(e), 78(5)(e) or 86(1)(b);
