An Act to amend the Police Regulation (Superannuation) Act, 1906, to exclude from its operation certain senior members of the police force who make the prescribed election. [Assented to, 27th June, 1984.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

1. This Act may be cited as the "Police Regulation (Superannuation)

(Election) Amendment Act, 1984".

Commencement

(1) Sections 1 and 2 shall commence on the date of assent to this Act. (2) Except as provided by subsection (1) , this Act shall commence on the day appointed and notified under section 2 (2) of the Police Regulation (Promotions) Amendment Act, 1984.

Amendment of Act No. 28, 1906.

3. The Police Regulation (Superannuation) Act, 1906, is amended by

inserting after section IA the following section:—•

Application of Act

1B. (1) This Act does not apply to or in respect of a person

who—

(a)

is the Commissioner, a Deputy Commissioner or an Assistant Commissioner;

(b)

immediately before first being appointed as Commissioner, a Deputy Commissioner or an Assistant Commissioner, as the case may be, was not a member of the police force; and

(c)

has elected, by writing lodged with the Board, not to contribute to the Fund or take a benefit under this Act.

Police Regulation (Superannuation) (Election) Amendment.

(2) A person who first became a member of the police force by being appointed to an office referred to in subsection (1) shall, if subsequently appointed to any other office so referred to, be deemed for the purposes of that subsection to have been, immediately before the subsequent appointment, a person other than a member of the police force.
