POLICE REGULATION (SUPERANNUATION)

AMENDMENT ACT.

An Act to increase the superannuation allow- ances payable to retired members of the Police Force; for this purpose to amend the Police Regulation (Superannuation) Act, 1906-1951; and for purposes connected therewith. [Assented to, 4th November, 1955.] BE

Act No. 35, 1955.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legis­ lative Council and Legislative Assembly of New South

Wales in Parl iament assembled, and by the author i ty of the same, as follows :—

  1. (1) This Act may be cited as the " P o l i c e Regula­

t ion (Superannua t ion) Amendment Act, 1955 . "
(2) The Police Regulat ion (Superannua t ion ) Act,

1906, as amended by subsequent Acts and by th is Act, m a y be cited as the Police Regula t ion (Superannua t ion) Act, 1906-1955.

(3) This Act shall be deemed to have commenced upon the first day of May, one thousand nine hundred and fifty-five.

2 . The Police Regulat ion (Superannua t ion) Act, 1906- 1951, is amended—

(a)

by inserting at the end of section seven the following new subsection:—

(3) The annual superannua t ion allowance

payable before the commencement of the Police Regula t ion (Superannua t ion ) Amendment Act, 1955, and in pursuance of subsection one of this section and increased by the opera t ion of sub­ section two of this section, or in pursuance of

subsection one of this section, to any member of
the Police Force (hereinaf ter re fe r red to as

" r e t i r e d m e m b e r " ) shall be increased, as from

such commencement, by—

(a) one-sixth; or

(b)

an amount equal to the difference between the annual superannuat ion allowance so payable to the re t i red member and the annual superannuat ion

allowance

allowance which would be payable to a member of the Police Force re t i r ing a t such commencement and hav ing r ank and service equivalent to tha t which the re t i red member had a t the t ime of

his re t i rement ,

whichever is the less.

(b)

by inserting at the end of section ten the following new subsection:—

(3) A n y annual superannua t ion allowance

g ran ted before the commencement of the Police Regulat ion (Supe rannua t ion ) Amendment Act , 1955, in pursuance of subsection one of th i s section and increased by the opera t ion of sub­ section two of th is section, or in pursuance of subsection one of this section, to any member of the Police Force shall be increased, as from such commencement, by—

(a) one-sixth; or

(b)

an amount equal to the difference between the annua l superannua t ion allowance so g ran ted and increased, or so granted , as the case may be, to such member and an amount equivalent to th ree -quar te r s of the sa la ry payable a t such commencement to a member of the Police Force hav ing rank and

service equivalent to t ha t which such
first-mentioned member of the Police Force had a t the t ime of his disable­ ment ,

whichever is the less.
