(AMENDMENT) ACT.

An Act to amend the Police Regulation (Superannua- Elizabeth n,

tion) Act, 1906-1958, so as to increase

superannuation allowances payable to retired

members o f the Police Force; to amend sections

12c, 33 and 35 o f the Pohce Regulation Act,

1899, as amended by subsequent Acts; and for

purposes connected therewith. [Assented to,

1st December, I960.]

T>E it enacted by the Queen’s Most Excellent Majesty, by " and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows: —

1.     (1) This Act may be cited as the “Police Regulation short title

and Superannuation (Amendment) Act, 1960”.

(2) The Police Regulation (Superannuation) Act, 1906, as amended by subsequent Acts and by this Act, may be cited as the Police Regulation (Superannuation) Act, 1906-1960.

(3) (a) The Police Regulation Act, 1899, as amended by subsequent Acts and by this Act, may be cited as the Police Regulation Act, 1899-1960.

(b) The Public Service and Police Regulation (Amendment) Act, 1960, is amended by omitting subsection two of section three.

fa) the amount shown opposite such range in

the second column of the said Table; or

(b)

except in a case to which range (viii) applies, an amount equal to the difference between such annual superannuation allowance and the amount in the third column of the said Table shown opposite the range within which such annual superannuation allowance falls,

whichever is the less.

by inserting at the end of section ten the following new subsection : —■

3. The Police Regulation Act, 1899, as amended by

(a) (i) by inserting at the end of paragraph (b) of

(ii)  by inserting at the end of the same subsection the following new paragraph ; —

Any annual superannuation allowance to which a member of the police force referred to in paragraph (c) of this subsection is entitled under the Police Regulation (Super­ annuation) Act, 1906, as so amended, shall commence from the date upon which his exten­ ded leave, if taken, would have commenced;

(iii)  by omitting from subsection two of the same section the words “ (whether annual leave, extended leave or any other form of leave whatsoever)” and by inserting in lieu thereof the words “other than extended leave” ;

(iv)   by inserting at the end of the same section the following new subsection : —

(3) This subsection shall apply to and in respect of members of the police force who at any time after the commencement of the Police Regulation (Amendment) Act, 1957, and before the commencement of section three of the Police Regulation and Superannuation (Amendment) Act, 1960, retired therefrom and were paid the money value of extended leave in pursuance of subsection two of this section.

S o much of the period of extended leave which, if taken by any member of the police force to and in respect of whom this subsection applies, would have expired before the com­ mencement of section three of the Police Regulation and Superannuation (Amendment) Act, 1960, shall be counted as service for the purpose of calculating any annual superannua­ tion allowance or gratuity payable to and in respect of such member under the Police Regulation (Superannuation) Act, 1906, as amended by subsequent Acts.

Such annual superannuation allowance as adjusted by the operation of this subsection shall commence—

(a)

where the period of extended leave, if taken, would have expired before the commencement of section three of the Police Regulation and Super­ annuation (Amendment) Act, 1960, from the date following that upon which all leave of absence (whether annual leave, extended leave or any other form of leave whatsoever), if taken, would have terminated;

(b)

where a portion only of the extended leave, if taken, would have expired before such commencement, from such commencement.
