An Act to amend the Police Regulation Act, 1899, for the purpose of requiring a priority list of sergeants who are qualified for promotion to the rank of inspector to be prepared each year. [Assented to, 2nd December, 1976.1

"DE it enacted by the Queen’s Most Excellent Majesty, by -D and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

1. This Act may be cited as the “Police Regulation

(Amendment) Act, 1976”.

As soon as practicable after the date of

assent to the Police Regulation (Amendment) Act, 1976, the Commissioner shall prepare or cause to be prepared a priority list in the same terms as referred to in subsection (1) in respect of vacancies occurring or expected to occur in the rank of inspector during the period commencing on that date and ending with 30th September, 1977.

If, in relation to any period of 12 months

referred to in subsection (1) or the period referred to in subsection (2), as the case may be, it appears to the Commissioner that vacancies occurring in the rank of inspector will exceed the number of sergeants whose names are included in the priority list prepared for that period and who are quahfied to be promoted to that rank, the Commissioner shall prepare or cause to be prepared a supplementary priority list containing the names of such number of sergeants, quahfied as referred to in subsection (1) and who are to be recommended for promotion to the rank of inspector, as may be necessary to enable the excess vacancies to be filled.

The Commissioner may appoint such panels

or committees, comprising such number of members of the police force of or above the rank of superintendent, as he thinks fit for the purpose of advising him or assisting in the preparation of a priority list under this section.

(5)

The names of sergeants whose names are

to be entered in a priority list prepared under this section shall be placed in the list according to the order in which those sergeants are to be recommended for promotion.

(6)

When a priority list has been prepared under

this section, the Commissioner shall, as soon as prac­ ticable thereafter, cause a copy of the list to be served on—

(a)

every sergeant whose name is included in the list; and

(b)

every sergeant whose name is not included in the list but who is senior in that rank to the most junior sergeant whose name is so included.

Service of a copy of a priority list under

subsection (6) may be effected by delivering the copy to the sergeant in person or by sending it to him by certified mail to his address last known to the Commissioner.
