s1 2 s5 Police Powers and Responsibilities (CHOGM) Regulation 2002 No. 14, 2002 1 Short title This regulation may be cited as the Police Powers and Responsibilities (CHOGM) Regulation 2002 . 2 Notes in text A note in the text of this regulation is part of the regulation. 3 CHOGM is a special event (1) The Commonwealth Heads of Government Meeting ( “CHOGM” ) being held at Mudjimba and Yaroomba from 2 March 2002 to 5 March 2002 is a special event for the Act, chapter 9, part 2. 1 (2) The following are also special events— (a) functions attended by CHOGM delegates; (b) entertainment events held for the benefit of CHOGM delegates; (c) the accommodation of CHOGM delegates, CHOGM officials and other officials associated with the organisation of CHOGM. 4 Special event site Each area included in schedule 1 is a special event site. 5 Period of special event The period for which the event is a special event starts on 25 February 2002 and ends at midnight on 7 March 2002. 1 Act, chapter 9 (Other powers), part 2 (Preserving safety for special events)
s6 3 s8 Police Powers and Responsibilities (CHOGM) Regulation 2002 No. 14, 2002 6 Where authorised persons may exercise powers for special event During the special event, an authorised person may exercise powers the authorised person has under the Act, chapter 9, part 2, division 5 2 at a special event site. 7 Prohibited items Each item in schedule 2 is a prohibited item. 3 8 Expiry This regulation expires on 7 March 2002. 2 Act, chapter 9 (Other powers), part 2 (Preserving safety for special events), division 5 (Powers for special event sites). An authorised person may exercise a power in division 5 only if the person’s instrument of appointment states the person may exercise the power. 3 Under the Police Powers and Responsibilities Act 2000 , section 356 (Prohibited items) taking a prohibited item onto, or possessing a prohibited item on, a special event site without a reasonable excuse is an offence.

The Hyatt Regency Coolum land on either side of David Low Way at Yaroomba. 2. The following roads at Yaroomba— • Tanah Street West between Arlington Court and David Low Way • Warran Road between David Low Way and Jenvor Street • David Low Way between Warran Road and the intersection of Tanah Street West and Tanah Street East. 3. The beach at Yaroomba adjacent to the Hyatt Regency Coolum and between a direct line continuing seaward from the southern edge of Warragah Parade to the Pacific Ocean and from the northern edge of Tanah Street East to the Pacific Ocean. Land at Mudjimba 1. The area enclosed by Nojoor Road, Ocean Drive, North Shore Road and the Maroochy River, Mudjimba, other than the following— • lot 1452 on CG 6277 • lot 591 on CG 1327 • lots 1 to 18 on SP 136012 • lots 0 to 5 on SP 136010 • lot G on SP 136008 • lot L on SP 136016 • lot F on RP 849416. 2. The following roads at Mudjimba—

Sunshine Coast Airport 1. The part of the Sunshine Coast Airport, Mudjimba that is not either of the following under the Air Navigation Act 1920 (Cwlth) — (a) a prohibited area under the aviation security program for the airport; 4 (b) a sterile area. 5 Note — The prohibited area under the aviation security program for the Sunshine Court Airport is the area used for the surface movement of aircraft at the airport. The departure lounge at the Sunshine Coast Airport terminal is a designated sterile area. 2. Friendship Avenue, Mudjimba. 4 See the Air Navigation Act 1920 (Cwlth) , section 22P (Aviation security program). 5 See the Air Navigation Act 1920 (Cwlth) , section 21 (Designation of sterile areas).

Examples — • animal manure • paint • a spear. 2. Any of the following under the WeaponsCategoriesRegulation 1997— • a category A, B, C, D, E, H or R weapon • a restricted item. 3. The following items — • an antique firearm within the meaning of the Weapons Act 1990 • a captive bolt humane killer • a crossbow • an explosive tool • a knife within the meaning of the Weapons Act 1990 , section 51 6 • a longbow • a major component part of a firearm within the meaning of the Weapons Act 1990 • a slingshot within the meaning of the Weapons Act 1990 • a spear gun • a replica of a crossbow, longbow or spear gun. 6 Weapons Act 1990 , section 51 (Possession of a knife in a public place)

A placard attached to a rigid object, for example, a piece of timber by which it may be held. 6. An animal, reptile or insect capable of causing physical harm if released in close proximity to a person. 7. An item, including a device known as a “dragon”, capable of— (a) attaching a person to an object or another person; or (b) preventing removal of any locking or connecting device. 8. Liquor, other than liquor to be sold or supplied on the site under the authority of a licence or permit issued under the Liquor Act 1992. 9. A manually operated surfski or surfboard. 10. A thing capable of emitting a sound loud enough to disrupt CHOGM. 11. A communication device, other than a mobile phone, capable of being used to organise activity designed to disrupt CHOGM. Example — A two-way radio. 12. Any of the following things capable of being used to cause harm to a person or to disrupt CHOGM— • an explosive Example s— 1. fireworks 2. flares. • glass and metal containers • projectiles • hand tools • a smoke bomb • a thing that is not a weapon but is capable of being used to cause harm to a person
8 Police Powers and Responsibilities (CHOGM) Regulation 2002 No. 14, 2002 SCHEDULE 2 (continued) • a thing capable of disguising or concealing the identity of a person • a thing capable of being used to climb barriers • a thing capable of being used to construct a stage, platform, tripod or tower or a structure similar to a stage, platform, tripod or tower • a thing capable of concealing another thing mentioned in this schedule.
