s1 3 s4 Police Powers and Responsibilities and Other No. 145, 2006 Legislation Amendment Regulation (No. 1) 2006 Part 1 Preliminary 1 Short title This regulation may be cited as the Police Powers and Responsibilities and Other Legislation Amendment Regulation (No. 1) 2006 . 2 Commencement (1) This regulation, other than sections 11, 14 and 18 and part 4, 1 commences on 30 June 2006. (2) Sections 11 and 14 and part 4 commence on 1 July 2006. (3) Section 18 commences on the day the Corrective Services Act2006 , section 124 commences. Part 2 Amendment of Crime And Misconduct Regulation 2005 3 Regulation amended in pt 2 This part amends the Crime and Misconduct Regulation 2005. 4 Amendment of s 3 (Information for surveillance warrant application) (1) Section 3, from ‘For sections’ to ‘the Act’— omit, insert— ‘For section 121(4)(c) 2 of the Act’. (2) Section 3(e)— omit, insert — 1 Part 4 (Amendment of Evidence Regulation 1993) 2 Section 121 (Surveillance warrant applications) of the Act

(4) Section 3(g)(ii) and (iii)— renumber as section 3(g)(i) and (ii). 5 Amendment of s 4 (Information for covert search warrant application) (1) Section 4(e)— omit, insert — ‘(e) the type of major crime for which the warrant was issued;’. (2) Section 4(g)(i)— omit . (3) Section 4(g)(ii) and (iii)— renumber as section 4(g)(i) and (ii). 6 Amendment of s 10 (Surveillance warrant application) Section 10(1)(b), (d) and (f)(iii)(B), ‘major crime or’— omit . 7 Amendment of s 13 (Disclosure of information under Act, s 145(2)(f)(ii) or (g)) Section 13(a)(ii), ‘law enforcement’— omit . 8 Amendment of s 15 (Declared law enforcement agencies) (1) Section 15, heading and subsection (1)— omit, insert —

Part 3 Amendment of Police Powers and Responsibilities Regulation 2000 10 Regulation amended in pt 3 This part and the schedule amend the PolicePowersandResponsibilities Regulation 2000. 11 Replacement of s 11 (Corresponding laws) Section 11— omit, insert — ‘11 Corresponding laws ‘Each Act mentioned in schedule 5 is a corresponding law for the provision of the Act mentioned in the part heading for the part of the schedule in which the Act is mentioned.’. 12 Amendment of s 13 (Declared law enforcement agencies) (1) Section 13, heading and subsection (1)— omit , insert — 3 Schedule 2 (Dictionary)

Note — This definition has effect for provisions about the use of information obtained under surveillance device warrants. ‘(2) This section is a transitional regulation. ‘(3) Under section 503 of the Act, this section and schedule 11A expire 12 months after the commencement of that section.’. 14 Replacement of sch 5 (Corresponding laws) Schedule 5— omit, insert — 4 Schedule 4 (Dictionary)
