151 Q Lturs fitrtu ANNO QUINTO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 21 of 1.966 An Act to Regulate the Procurement of Photographs taken for evidentiary purposes for the use of the Police Force of the State of Queensland [ASSENTED TO 15TH DECEMBER, 1966] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title . This Act may be cited as " The Police (Photographs) Act of 1966." 2. Meaning of terms. A term or expression to which a meaning is assigned by " The Police Acts, 1937 to 1964 " shall, when used in this Act, bear the same meaning and any derivative of such a term or expression shall bear a corresponding meaning. 3. Procurement of photographs taken for use of Police Force. (1) Where a print of a photograph- (a) has been made by or on behalf of a member of the Police Force in the execution of his duty; and (b) has been exhibited by or on behalf of the Crown or a member of the Police Force in the execution of his duty in a proceeding in any court or tribunal, a person who requires a print of such photograph for the purpose of answering a charge of an offence, the subject matter of or arising out of such proceeding or for the purposes of a proceeding commenced in
152 Police ( Photographs ) Act of 1966, No. 21 any court or tribunal (be it the same proceeding in which a print of the photograph has been exhibited or another proceeding) shall be entitled, subject to this Act, to have such print. (2) A person for whom a print of a photograph is made by or on behalf of a member of the Police Force in the execution of his duty, pursuant to this Act or otherwise, shall pay for each such print a reasonable sum to be fixed by the Commissioner appointed under " The Police Acts, 1937 to 1964 " for the costs and expenses of and in connexion with printing and supplying the same. (3) The Commissioner may, from time to time, fix different sums in respect of different classes, types or sizes of prints and may fix a slim in respect of the printing-and supply of aparticular print. (4) Neither the Crown nor any person shall be. held liable in law on account of the printing or supply of a print pursuant to this section. 4. Certain cases not within s. 3. The provisions of subsection (1) of section three of this Act shall not be construed to confer any entitlement upon a person who requires a print of a photograph for the purposes of a proceeding commenced in any court or tribunal on account of anything alleged to have been done or to have been omitted by any member of the Police Force or servant of the Crown in right of the State in the execution of his duty except where a print of such photograph has been exhibited in such proceeding.
