1110 Police (Photographs) Act Amendment Act 1985, No. 71 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same , as follows:- 1. Short title and citation . (1) This Act may be cited as the Police (Photographs) Act Amendment Act 1985. (2) In this Act the Police (Photographs) Act 1966-1981 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Police (Photographs) Act 1966-1985. 2. Amendment of s. 2 . Meaning of terms . Section 2 of the Principal Act is amended by- (a) numbering the provisions thereof as subsection (2); (b) inserting before subsection (2) the following subsection:- "(1) In this Act, unless the contrary intention appears- "marked print" means a print marked in a manner that highlights certain features or aspects of the subject of the print or points of similarity between the subject of the print and the subject of another print; "print" means a print of a photograph or part of a photograph and includes a marked print.". 3. Amendment of s. 3. Payment for photographic prints . Section 3 of the Principal Act is amended by- (a) numbering the first paragraph as subsection (1) and omitting from that subsection the words "of a photograph"; (b) inserting after subsection (1) the following subsection:- "(2) Where the person for whom a print is made as referred to in subsection (1) requires a marked print he shall pay in addition for each such print a reasonable sum fixed by the Commissioner for the costs and expenses of and in connexion with marking the print."; (c) numbering the last paragraph as subsection (3) and in that subsection- (i) inserting after the word "printing" where it first occurs the words ", marking"; (ii) inserting after the word "supply" where it secondly occurs the words "and, if necessary, the marking"
Police ( Photographs ) Act Amendment Act 1985, No. 71 1 1 1 1 4. Amendment of s. 4 . Entitlement to photographic prints . Section 4 of the Principal Act is amended by- (a) omitting the words "of a photograph"; (b) omitting the words "a print of such photograph" and substituting the words "a print identical to the print exhibited"; (c) omitting the words "such print" and substituting the words "a print identical to the print exhibited". 5. Repeal of and new s . 5. The Principal Act is amended by repealing section 5 and substituting the following section:- "5. Procedure to obtain print of exhibit . (1) A person who requires a print identical to an exhibited print referred to in section 4 shall, in writing- make his request therefor of the person who has custody of the negative of the print exhibited; and indicate therein the purpose for which he requires the print, and shall pay to the person having such custody the sum required by section 3 to be paid by him therefor. (2) If the person who has custody of the negative is satisfied that the person making the request is entitled as prescribed to a print identical to the print exhibited and that the appropriate sum has been paid, he shall cause a print identical to the print exhibited to be made and supplied. (3) Neither the Crown nor any person shall be held liable in law on account of the printing, marking or supply of a print pursuant to this Act.". 6. Amendment of s. 6. Certain cases not within s . 4. Section 6 of the Principal Act is amended by- (a) omitting the words "of a photograph"; (b) omitting the words "of such photograph" and substituting the words "identical to the print required". 7. Amendment of s. 7. What a prescribed purpose is . Section 7 of the Principal Act is amended by omitting the words "of the photograph of which a print" where they twice occur and substituting in each case the words "of which an identical print".
